Cleared but not cleared by virtue of that oddity of Scottish law, the 'bastard' verdict of 'not-proven'. In other words, we think you did it but can't prove you did, so we'll let you go on the basis that it is better to free a guilty man than imprison an innocent one.

I don't think you can use a not-proven verdict as a prescedent (I could be wrong though).

I have a recent experience of this type of gun under-reading but I think I'll settle for the 3 points rather than argue.

Caught at 2000 ft away.
Gun accurate of a range of up to 1000 ft.


Err. Sounds like a fuckwitted police officer being quick on the draw, so to speak and desperate to get another fine in the bank.

Serves the tosser right for being too keen.

Either that or the driver was very 'pally' with the guy who rolling road'd his car and stuck the limiter back on if it was de-restricted in the first place! Laughing

Same with that guy in the USA. Clocked at 205mph (apparently) but later a rolling road session proved his SP pegged out at 165mph Confused

From memory limiter would have restriced it to about 112mph, rolling road found only capable of about 107mph. Expert witness verified as not modified from import.

The guy's solicitor said it calls into question all cases where this type of detector used in the UK.

Possible user error by the cop Rolling Eyes

I think you will find the verdict was one of Not proven. Which means they were not satisfied with the case for the prosecution but not entirely convinced by the argument for the defence either. It tends to suggest that both parties are on ropy ground since if it was definativley proven that the speed gun was reading incorrectly, you would have expected a 'not guilty' verdict to have been reached.

Hummm, so what I'm reading between the lines is:

"This piece of equipment brings in a lot of revenue. As most people take the fine and points no argument, we ill continue to use it regardless of whether the equipment actually makes our roads safer"
