urgent help needed

My son bought a new 125 today and the front brake fell off at a roundabout nearly killing him dealer came and wanted to take the bike away saying it was there mechanics fault when asked what would have happened if my son was killed or anyone else who might have a bike done by this mechanic was told it was ok cause they had public liability and were covered where can we go for help and what should we do

Did he crash because of the brake 'falling off'?

If he did crash, he could file a claim for his injuries and damage to the bike. Solicitor may be required. No win, no fee etc. Could get protracted and messy.

If he didn't crash, and there is no damage to bike or rider, then it's a near miss. Lessons to be learned, heads may roll. It sounds like they're putting the fault right. What else do you expect? If you're not satisfied, then complain, don't buy another bike there, name and shame, whatever.

OK for them but wouldn't bring a dead rider back would it?

where can we go for help and what should we do?

Suggestions:

Don't just type a wall of text
Lay out the details in a clear concise manner
Independant witnesses to the failure/breakdown will help

I'll guess if the dealer has the bike back and has fixed it
then it may well be your word against theirs unless you have
witnesses or documentaion on your side

It's good to hear he isn't dead but there is a lesson to be learnt here. BOLTS. Brakes, Oil, Lights, Tyres, Suspension. Check them before every ride and especially when you pick up from a dealer.

A couple of suggestions, it may be possible for your son or even you yourself to take a photograph and post it on here ( this is not hard to do as most photos now do not require film as there are such things as "digital cameras", believe it or not some mobile phones are able to take a picture). My second point is that this should not be in the Workshop Sub Forum, it would be better if it was in "General" so try posting there (or even getting your son to do so himself).
