hi guys im hoping you can help me.

i passed my mod 1 and mod 2 last year.

but my theory test expired a few weeks after my mod 1. as i had taken the theory test in 2013 with the itention of doing my full bike test then, but didn't.

so anyway i took my theory test again after my mod 1 was already complete. i obviously had no idea that this would make any difference.

the DVSA examiner allowed me to take my mod 2 and said nothing about the new theory test date not matching what was on the mod 1.

so basically ive been riding my bike for a year illegally as they have only just informed me after i made several in debth inquiries to the DVLA.

is there any thing i can do like fight for a free re-test or something its lready cost me a fortune and im absolutely gutted i cant use my CBR600RR anymore untill the tests have been re-done.

i am beyond p1ssed off with the DVSA all they want is money money money.

hope this makes sense.

Your story needs clarification. Did you pass your Mod 2? If so, did you get your pass certificate and now have a license? If so why are you asking the DVSA stupid questions?

What made you want to tell them that your theory certificate was different between mod 1 and 2?

sorry its hard to explain.

yes i passed my mod 2. ive been riding my cbr600rr for the past 12 months under the assumption that everything was fine. yes i was given my pass certificate. the DVSA took my license to be updated but it was never returned. so after a few months i started to make enquiries. my license was returned but it still didnt have the correct codes on the back for over 600cc or whatever it is. so i sent it off 2 more times and it was still wrong untill now when they have finally told me i have to re-sit my mod 1 and 2 AGAIN!!!!!

i didnt tell them my theory was diferent. i passed my mod 1 it ran out. so did it again then took my mod 2 and passed. apparently this is not allowed for some stupid F**king reason

Yes, I'm sad to say that the expiry of your theory also resets your mod 1.

The good news is, you should only need to retake the mod 1, as the mod 2 pass is still current.

PJAY are you sure.? there letter clearly states that i must re-take both parts ? i'll be happy to do the mod 1 again obviously as it is easy.

im just angry that they didnt say anything. i could of gone years and years not even knowing i was doing anything illegal

Considering that you will have both mod 1 and mod 2 passes on the same theory, I don't see why there would be a problem.

They might say that you have to do the mod 1 before the mod 2, which you can prove you did, so that is fine.

So you will have a mod 1 and a mod 2 passed, albeit back to front, but legally, as far as I can see.

Mind you, this all means fuck all to the DVSA, they will probably be utter pricks about it and tell you that they have reviewed your case and decided that even though it is unique, you have to do it all again.

yeah to a normal person that would make sense. i can see me loosing my sh1t when i call them on monday.

im sensing the utter pricks option is my most likely outcome. ill keep you posted anyway.

ive even emailed MCN news to see if they have heard of this situtaion before and if not it needs highlighting more clearly by the DVSA.

When your theory expires, it invalidates your mod 1 pass.

This makes absolutely no God damn sense, but rules is apparently rules.

You don't have a license.

what will i need to tell the examiner that my bike is restricted ? or someone else rode it there for me?

It doesn't need to be restricted for the test. Get a friend to pillion you?

ahh right ok so aslong as i have L plates on it for mod 1 and 2 i should get away with it. i assume the asessor wont really care as im taking all the risks.

Just don't rub it in his face, you should be fine. L plates, and while you don't have to wear hi-vis, he'll be used to seeing it on candidate as it is a requirement while under instruction. £1 shop wally-bib should suffice.

Maybe take a safety pin or two too - in my experience those cheap ones have a 'Velcro' fastening that doesn't. Or it if does it opens at anything more than town speeds and leaves you flying a dayglo cape. Not specifically a problem but it can get annoying if you want to be concentrating on other stuff, like passing a test.

good advice thanks lads.

ive got MCN bike magazine on the case helping me try and find some sort of insurance to do tests on my own bike.

DVSA are yet to properly reply. takes upto 10 days. Sad

Personally, I'd just wing it.

Do both tests on your own bike. Popo will be happy with you producing pass cert if they pull you for whatever reason, as long as you don't say "oh I'm just on my way to do my tests for this bike"
Wouldn't bother with specific insurance. Mod 1 is five minutes. Mod 2 is up to forty and you'll be riding like Mrs Marple under test conditions anyway.
You've been riding uninsured for a year anyway.
