Yesterday night I had a couple pcso's come around.. It wasn't anything new I have them around constantly due to noise complaints (apparently) Anyway they started it off with is this bike insured? I said yeah because I had it insured its an old bike I was trying to fix it so I had it insured for when I get it moted and that.. It turns out the insurance on the bike was cancelled which shouldn't matter anyway because the bike was parked up in my driveway and hadn't been ridden all that week. Which they didn't want to believe.. They ended up calling the actual police who came down then were trying to get me to sign stuff saying "its nothing important" stupidly I did and before no time they had a recover truck outside my house and took my bike.. Looking back I shouldn't of signed anything they decided to come pretty late almost 10pm so I wasn't completely switched on, is there anything I can do now should I call a sollictor ? thanks

You gonna be arse-raped.

You signed... Doh! Doh!

A few questions;

Do you remember what exactly you signed?
Did you question them at all?
What did you admit to?
Did you tell them they are on private property?

I can see why the PCSO's didn't beleive you after you said it was insured when it wasn't, plants mistrust, even if it was a mistake to think it was insured.

I'm guessing they've taken it to the pound now?

What do you use the bike for, commuting, touring or riding about with your mates with no helmets and scarves around your faces popping wheelies as you run red lights?

I may be a bit naive here, but i don't get it.

why do some people feel the need to attention seek like this? i get the whole 'offensive troll' thing - theyre idiots, but they do it to wind people up and get a kick from it.

but this? this is like "oh my god, i'm such a fag, i have no friends so im going to waste shedloads of time posting fake stuff on a biker forum, JUST to get someone to notice me"

is it that simple? are some people really just plain weird/stupid?? or have i missed the point completely Laughing

Troll notwithstanding.

Being the registered keeper of an uninsured vehicle is an offence unless you have made a SORN declaration. Regardless of where it's kept.

Been there, been to court, paid the fine.

I wasn't aware they had the power to seize for that reason from private property.

Do you have to prove delivery of the SORN declaration or just that it was sent?

The onus is on the keeper. They weasel-worded their way round the interpretation act for the continuous insurance requirement.

Delivery, according to a reputedly lost appeal in Crown Court.

And yes, the burden of proof is explicitly on the defendant, and it requires that "evidence is adduced that is sufficient to raise an issue with respect to [having SORNed]"

https://www.legislation.gov.uk/ukpga/1988/52/section/144B

Seizure can be done on private property on a reasonable belief that the vehicle had been driven in a public place without insurance, with no limit on time.

There's also some debate over what constitutes public and private for purposes of insurance. If a neighbour, postman or copper can walk up to your front door, then it's arguably a place to which the public enjoys a general right of access.

Allegedly. I suspect if someone threw in the universal postal union act along with comments along the line of 'can I have the secretary of state for transports itinery for the next year' it would be shown that this was a nonsense.
