Embarassed Ok so a "friend" has bought a house, an old cottage and bought outright no mortgage etc recently, moved in around June time.
now the previous owners were an old couple, they told him that they had already given the council his name for the council tax as they were moving out of the county.
move on 2 months and he gets a council tax demand, with his name on but wrongly addressed, lets say he lives at 1 dave green Rolling Eyes
the council tax demand is to 1 dave green cresent, which does exist on a new estate 500 yards away.
He rings the council dept on the letter, they say that the previous owner always paid it at cresent and that 1 dave green does not exist, despite the girl on the phone looking on google maps and agreeing that 2 dave green is next to no 1 and 3 !! and he has to call and register it as a new build (its 200 years old at least).
He tried to call and sort it with planning dept but couldn't get through.
Kinda forgot to chase it up until another letter arrived still wrongly addressed to dave green cresent, the postie I guess or the tenant at 1 dave green cresent has put it through the door..
Soo does he just ignore it as its obviously not his property
or spend hours on the phone sorting it.
He has also received a voting registration form from the council, which was correctly addressed but obviously to "the occupier" ..
how will this pan out as obviously he has not paid any council tax for the last 3 months but anyone chasing it will not have the correct address??
pay up and look big? Question
or maybe ring up in a while and register it as just moved in at correct address?.

got a copy of the deeds?

go in to council office with deeds and incorrect letter and suggest they correct their records so you can pay them the money you owe. If they don't then ask if they're refusing to accept payment for 'correct address' and demand supervisor.

Chase it up, don't "kinda forget" about it and do keep chasing it up until it's sorted.

Ignoring it and hoping it will go away will backfire on your friend when the council notice that nobody at 1 Dave Green has paid council tax since April.

I bet the residents at Dave Green Crescent are in for a shock when the council realise they've been collecting one tax for two properties.

Hang on, so council aren't aware property should be paying council tax.
The corresponding address does exist and is being paid.

Why not just leave it, keep quiet and hope the council don't work it out?
Worst of the worst, they have to backpay, so just put the money to one side and if the council never notice then happy days.

Well. Get this filled in the start with. That's a good documentary basis for sorting their shit out.

Thing I'd worry about is if they turn around in future and say you owe them back tax because it's not been paid onthat property.

I'd also be concerned your bandingmay be based on a driveby of the new build it's being addressed to and not the actual building. Again, if they notice this mistake, it'll all come down on your head.

At risk of sounding like Roger. Go like this:

1) Letter of dispute explaining facts clearly and concisely with documentary evidence.

2) Complaint. Headed as such.

3) Local government Ombudsman.

It goes without saying that you should keep all the tax money somewhere safe for the banding your property should be because you WILL have to pay it eventually.

Most councils are very quick to go for a CCJ for unpaid council tax so keep your paper trail (including proof of posting) to show to the magistrate. It could actually pan out to your advantage if they take it to court because when you turn up, it could well force them to sort their shit out.

Remember, being taken to court for non payment doesn't affect your credit rating. Courts are there to settle disputes over payments. It's not paying up when ordered to that screws you over.

Not true really. Councils are owed a fortune in unpaid CT. Added to that problem is up here in Scotland you pay for water and sewage through the CT bill. So when people get CT benefit they also they fail to notice it doesn't cover water and sewage so build up W+S debt. Most of the time its an honest mistake but the whole problem could be solved by just putting W+S on a separate bill. Council doesn't see that simple solution though.

It's probably different in Scotlandshire....Leicester city council are pretty quick at taking people to court over unpaid council tax. Surprised that sewage and water rates are part of council tax, is there not a Scottish Water or equivalent?

A friend of mine played a similar game. Names have been changed to protect the innocent, but let's say his name was Rick Jagger. Someone at the council Freudian-changed his bill to Mick Jagger. He sent it back with a "not known at this address" for shits and giggles really. There was a bit of back and forth until they eventually got his name right, at which point he paid everything he owed because councils follow through on court and CCJ threats all the time.

Half a lifetime ago I was tried in my absence for non-payment simply because I had a habit of putting mail on a pile and not opening it. IIRC I simply had to pay the rest of the year up-front to make it all "go away" but yeah, councils are money-grabbing and humourless so get it cleared up eh.

Aye.

I landed up with a CCJ because I had my CT on direct debit and so didn't bother my arse opening the letters.

Turns out that for some reason which has never been fully explained the fuckwits took the first three payments then stopped taking them and started issuing late payment demands.

First I knew about it was I had baliffs at the door. Fucked them off and opened all the envelopes I'd just been filing under "council tax", assuming they were payment receipts. They had started proceedings at the second missed payment (same envelopes).

I just paid it over the phone then told the baliff the debts been paid so GTFO when he turned up the next day.

Hopefully this has been sorted now the council are sending an inspector out to actually check it exists. Apparently something to do with royal mail records.. Wonder if the person at 1 dave green cresent has ever paid their council tax lol.
