Legal advice about a pre arrest voluntary interview could involve something about how answering any of their questions is unlikely to be in your best interests.

If you're going to be arrested or in for a caution +3 you'll have the option of free and independent legal advice prior to the interview.

Just to play along, what does "pre-arrest" mean? That you/your "friend" is expecting to be arrested, or that they've been invited to attend an interview?

Even in the latter case, you/"friend" can require a session with the duty solicitor. Although you already know what they'll say.

Chance of a solicitor on here? quite likely being as theres fuckloads of members....


Reason i ask is the ones ive spoken to have given conflicting information and dont seem to want to answer regarding a statement retraction pending against me.

I wont post info but it wasnt my fault i was defending myself.

There are bound to be one or two criminal law solicitors among BCF members. However, they wouldn't give advice here, as it would amount to professional advice, for which they would be liable to you under the rules of negligence and/or their professional code of conduct. There's no such thing as informal professional legal advice. A solicitor must give competent advice, and if he/she doesn't, liability arises.

However, the problem is clearly twofold. First, you suspect you're in trouble. Second, you can't afford professional advice and you don't have friends in the legal profession.

The latter part of your problem means the odds are stacked against you, unfortunately. If you were defending yourself, you had to have acted proportionately. However, you're posting on here. You haven't been arrested ('pre-arrest'?) So, worrying won't help. Sometimes these entanglements ensnare us in life.

What's a "statement retraction pending"? You can't "retract" a statement per se. What has been stated cannot be unstated. You can withdraw the allegation by saying that your original statement was a lie, or can make it clear that you no longer wish actively to support a prosecution or defence.

The rozzers and CPS can still continue anyway based on the original statement, particularly in domestic violence cases if there's evidence of coercion or witness tampering. Did you punch your tranny granny?

The quality of any advice you get will be exactly as good as the information that you choose to provide.

Arrest is imminent, been avoiding them for the past week whilst attempting to sort something out, theyve been to family and friends looking for me seeking to arrest....

Short: was attacked and defended myself, i came off much better... now being chased for it... is gay..

They'll give up soon, but you don't want to be arrested (well, I don't), since it's disclosable on some travel visa and security clearance applications, even if you're never charged or convicted.

To avoid that, you could turn up at the local cop shop and offer to give an interview under caution voluntarily, stressing that you'll co-operate fully and there's no need for arrest. Bring a calm, credible witness to the front desk.

Then as soon as you're sat down, say "duty solicitor, now", followed (probably) by saying nothing, as is your right.

If you're arrested under those circumstances - long after there's any reasonable argument that it might be necessary to avoid destruction of evidence or witness tampering - then enjoy your compo claim.

Whether you say nothing, or say "Wasn't me, didn't do it, wasn't there, and anyway, bigger boy started it," really comes down to whether it's he-said-she-said, or if there are witnesses and/or CCTV.

That's why you should follow the fully informed advice of a professional solicitor, not interforums speculators.
