Basically during my commute I'm getting a problem when accelerating it's reluctant to go, and is very Jerry during acceleration especially when overtaking on the motorway. It's like someone holding the back brake on and releasing slightly.

Does it more when I've just filled up, bike also seems to be quite lurchy when changing down a gear etc.

2008 fuel injected model with 25,000 miles. Doesn't do it all the time maybe one ride out of eight.

Most recent was 20,000 miles so probably 6 months ago. Oil and filter change. I'm not sure if dealer did it, oil filter looks new and oil looks a nice colour. But not sure if they did one. They gave it a mot.

Vauxhall claimed they serviced our car, 2,000 miles later it needs a service!!!

Your bike has many sensors, connections and wires giving the bike brain (e.c.u.) signals, the brain will give you more fuel and spark at the correct time providing it receives the info.
It could be poor / corroded connections on any after 8 years.
If you decide to check all you must removed / disconnect the battery first.

Is it worth me taking it back to the dealers on Monday? Not sure what warranty I have though? Out of 16 rides since I bought it, this problem has happened twice.

I'd be changing the oil and filter anyway after 5000 miles, also if they didnt change the plugs who knows when they were last done, i'd check and most likely change them too and check the ht lead connections to the plugs ect.

Also try a good quality fuel cleaner like bg44k could be clogged injectors.

Is it when its raining or when its dry?

If it's a year/5000 miles since the last service then it's due one anyway, but the only service item that is likely to make it jerky would be totally worn out plugs. I wouldn't expect a modern set of plug to be totally worn out after 25k even if they were the originals, but it is possible.

It's fuel injected, so a decent battery is critical to keep the thing running well. If I was going to start randomly swapping parts in the hope I fix it, I would start with the battery. If it's more than 5 years old, or has spent a year or more sat in the shed doing nothing, then the battery is probably knackered.

The other place I would look is the brakes. You said it feel like someone applying the back brake, and bandits are notorious for their brakes getting sticky. The solution is a proper clean - which won't always be done as part of a service. If they're still a bit sticky, you need to do an even better clean, including removing the pistons and seals and scraping the corrosion out of the caliper body. This is certainly not done as part of a service at a shop.
