Hello,

Unfortunately, while coming home from work today I came off my 2013 Kawasaki ER6N, as I was travelling down a 4 lane road (2 lanes for each direction) at approximately 15/25mph (traffic + pulling off from lights), I had a vauxhall astra from the left hand lane swerve into me in the right hand lane, had no chance to go anywhere, ended up swerving into the pavement, losing control... coming off.

I wanted to ask you guys regarding compensation/claims.

I (and 3 witnesses - mother/daughter and another woman) all know it was not my fault, as car driver swerved aggressively into the right hand lane, no signal, no indication at all - however I only got a partial plate and make/model, so not sure if the driver will even be found.

There was also no contact as I swerved away from him into the curb.

I have third party, fire and theft.


My bike has suffered lots of damage to the offside (coolant bottle is completely gone also, so cannot be ridden until replaced, however all else should fingers crossed be purely cosmetic, however too early to say).
With myself I feel lots of pain to the wrists (hard to move them around) and it's very difficult for myself to walk due to my right leg - I don't think anything is broken but it's hurting quite bad.

With this in mind am I in anyway able to claim any compensation - assuming (pessimistically) that the drivers no. plates will not be found at all. Perhaps by going to third party solicitors who deal with these sort of incidents?

Just asking for general advice.

Bad luck it was indeed, it's a highstreet and 2 lanes on each side, I got shunted onto the kerb, where I went over and dropped, thanking whoever was watching above that there was no cars... I was right next to him, so my reactions were fine, if the kerb wasn't there it would've been a bit of screaming and moving on, but I'm never THAT lucky.

Thank you mate, that's something to look at, I'm looking to do one soon, as with tradition - just need to relax for a bit though, happened like 2 hours ago.

We don't ask for much around here. Razz

Have you reported the driver to plod for failing to stop? I would say you should visit a&e but it'll be full of drunk people until the New Year so if you've got a minor injury unit nearby then that'll be quicker than waiting in a&e.

Where's your bike at the moment?

I did indeed, with it being a highstreet I had another biker/delivery driver and 4 other saints helping me, I was on the ground, screaming of pain trying to get up and move my bike out (stupidly enough I care about my bike more than myself lol) but had other people telling me to stay down blah blah, I heard them talking about how shocking it was for the guy to pull out, so I'm certain it was the drivers fault (I say guy, I don't know who it is sadly male/female it) quickly enough had a pcso pull up, take some dets, then some coppers pulled up and took dets and made sure I was ok, I asked them to cancel A&E since I could do something that resembles walking more or less.

The coppers then said they can't take the bike, however luckily I was able to leave it at my works parking place, since I was 2 minutes out from there, so hopefully it won't be nicked - (chances are stupidly slim, but I am a pessimist), coppers proceeded to drive 4/5 miles out and I just had to limp 1 or so miles home (couldn't take me further as out of borough).

In regards to A&E I need to get to work tomorrow, and it's getting late today, so after I limp to work tomorrow I will call the MIB guys and anyone else relevant (including insurer) to inform and be informed, I will see if I can find a place that would be quicker though.

And the diagram will come, don't you worry! Smile

It's nothing to do with your own insurance company, all they'll do is try to pass you to paralegal claims management derps.

Sounds good, is it a no win no fee sort of basis (My understanding of legal things such as this is limited, however I hope you understand what I mean).

I do also thankfully have the things, the helpful policewoman offered to take my phone and wrote some numbers down and their names, so hopefully that front is covered.

Was this kerb a central Reservation or on the other side of the two oncoming carriageways?![/quote]

This was the 'central reservation' it looked like the central part where it's the part for the peds to cross the road (I think that may be the reservation, sort of)

I'm hoping so, at the event itself, there was 1, facing away... sadly

I'm hoping up the road they can identify the driver, with it being a high street.

I hope this is of use, my drawing and scaling is poor, I'd rather keep the location private since it's not too far from where I commute and work, but it's that basic, just a car pulling out on me in a straight 2 lane road (2 lanes the other way aswell)

So the driver caused you to crash and fled the scene. Call the police, have them check the CCTV in the area at the time of your crash, find car driving around the area matching partial plate & description.

Don't know if all that's easier said than done but I'd hope the police can do something to get the footage. At least I think that's what I'd do.

Anyway glad you aren't potato and I hope you find the cunt.

A Google Maps link should make things clearer.

And as much as we loves you or hate you, knowing that a road is not too far from where you commute and work isn't going to be enough for even the most dedicated stalker to find you.

We're still trying to understand the road at the moment. Laughing

And to point out a slight contradiction in your first post (yeah yeah yeah, it's getting late and you've been crashed today), you say you had no chance to go anywhere so you swerved into the pavement. There's a whole can of worms there. Wink

I did my own MIB claim rather than going through solicitors, it was all dead easy, if a little long winded, and I kept everything at the end rather than giving 25% to a solicitor.

Police are useless, they can't be arsed to do anything unless it's handed to them on a plate.

I had a similar situation where a driver pulled out of a parking space without looking, I swerved but hit the deck. Police refused to do anything since I didn't collide with the vehicle, they even knew who the driver was. Wish I bloody hit them now...

You don't really need a coolant bottle. It's just for expansion. Some liquid cooled bikes don't even have one.

I doubt your bike is getting hot enough to have coolant escaping at this time of year.

Stick the end of the hose that used to go to the expansion bottle in an old pop bottle cable tied to the frame and ride the bike.
