In my opinion it is easier to pay the fine and get the points, less hassle for sure. I do not understand why knowingly you want to make the matter worse and potentially get into bigger trouble.

If you've very lucky, you may be given an opportunity to deal with this by a "fixed penalty". This means accepting guilt, getting 3 points, and paying a £100 bribe (not a fine) in order to avoid a prosecution in court.

However, at that speed, it's possible that you may be prosecuted instead. That means a day in court where some CPS cheap-suit exclaims about all the kittens you could have killed. You could receive up to 6 points, and a far larger (actual) fine than the £100 fixed penalty bribe.

If you ignore the demand to identify the rider, you'll get 6 points just for that.

If you intend to fite it, I'd get over to PePiPoo and be prepared to be very specific about the event: all the documentation that you've received, and the exact location.

I heard that it's feasible that if someone is testing your bike prior to a sale, gets caught by a speed trap, you only need offer his/her details for the courts/police to chase up. It wouldn't realistically be your fault if he/she gave you a wrongun.

It could and almost certainly has.

No. The onus would be on the prosecution to prove the owner was committing the offence. Naming a test rider, from the dodgy details they gave you is not committing an offence.

If they can prove you have given dodgy details then sure, that's terrible and you should get arse raped in clinky for 8/12 months.

man up and pay the fine - 39 in a 20 , you're super lucky its not an instant ban. see the silver lining you have been given and count your lucky stars.

I once got pulled for doing 59 in a 40 (ironically late for my bike test). I wasn't going 59 more like 70 but the copper gave me a huge favour. Yes sir no sir 3 bags full sir and off I went 3 points heavier and £100 lighter. Massive silver lining being that I'd left my Scoob at my mates and was in my dads Mondeo - id've been going triple digits otherwise.

moral of the story - man up, pay up

They let me down when I needed them. I'm owed money by them as far as I'm concerned. I'm determined to pay not a single penny. And three points may be small for you but it's three away from loss of licence for me. Imagine yourself about to be put on 9. It would affect riding hugely. I'd be on my speedo like a hawk when I should be having a good time on the bike.

No, but a person must not cause or permit any other person to use a motor vehicle on a road or other public place unless there is in force in relation to the use of the vehicle by that other person such a policy of insurance or such a security in respect of third party risks as complies with the requirements of [RTA 1988].
