Arrghhhh!

The thing that originally brought me to these forums has happened again. Once more I've committed the henious crime of riding my motorbike in a bus lane and from the look of the piccys it might even be the very same camera.

However after my success in challenging my speed camera ticket (the offence timed out this week without a prosecution) I'm not just going to pay up meekly this time but intend to challenge the system at every turn.

It may well end up costing me more in the end, but I'm totally fed up with this, especially given that some bus lanes in London now permit bikes anyway. Evil or Very Mad

You definately should Thumbs Up Thumbs Up i got fined for going in a bus lane although i was only in it for a second when filtering through the middle of traffic, which really pissed me off!! Post to let us know how you get on,

btw how did you go about getting a off a speeding ticket Question

I sent the PACE letter and never heard anything further from them, the whole thing just seemed to get dropped and now the six month time limit has recently passed.

Well done for getting off the speeding charge. If you don't mind me asking how long did it take for them to send you the original pictures? I ask because it was only late november that we were discussing this particular speeding charge.

Next time you get flashed by a camera, ask for a calibration certificate for the camera... Will get binned straight away.

Sorry to go off on a tangent slightly, but is the general gist of the PACE letter "yes, it was me but because you didnt caution me you cant use this confession to prosecute me"?

Don't want to sound like I'm having a go, because I'm not, but if you've been caught riding in that bus lane before, at the same place, by the same camera, why did you do it again? I ride in bus lanes, but only where I know there are no cameras.

Cos I concentrate on my riding and not trying to remember where the cameras are.

It took them a fair while (but on the other hand I waited till near the end of the allowed period before I asked for the pics). The original incident was on the 11th September.

How would i go about this if for example if get a ticket in the post for speeding do i simply dispute the fine for the simple reason of "i wasnt speeding" then ask for evidence of the offence therefore asking for the calibration certificate.

Surely something like this would not work if you were really breaking the speed limit ie 60 in a 30 or is it the accuracy of the camera you are challenging??

Ask for a callibration Certificate. They should be callibrated daily. And they should have signed certificates that the camera has been callibrated. If it hasnt, then it may not be set up right and therefore you want speeding! Wink

Same as if you get breathalized and it comes posotive. Challange them as the police are supposed to turn their mobile phone off when doing it. Because it interfeers with the breathalizer... And NO copper does turn their phone off. So bring that up in court. They will beable to check on the system of the phone has been switched off at the time you was breathalized.

I think you will find that if the camera has the appropriate calibration certificate you will find that do not have to produce it until you go before the court.

So if you request to see it and they don't have one then they will not proceed with the prosecution. But if they do have one and you still continue to play russian roulette questioning whether the camera was properly calibrated you will end up before the judge. And when you look an idiot in court because they have played everything by the book, whilst you tried to get off the charge, you will end up with more points and a larger fine from the judge instead of accepting the 3 points and £60 fine you would have if you had accepted the speeding charge in the first place.

I'm not saying don't try to get away with it and if you are 100% confident they are wrong then you should dispute it right to the end, but if they have got you bang to rights don't be an idiot, draw a line somewhere and accept the minimum punishment.

This may be a tiny bit off the topic, but what are those vans in london that have the congestion charge sign on them and also have a camera sticking out the top?? Are they to enforce congesion charging or do they also catch you for speeding. Shocked

They seem to be parked where you don't notice them untill the last second Confused

It's "I'm complying with the road traffic act by submitting these details, but I aint signing that NIP that automatically says I'm guilty".
And "I can't remember who was riding but hey here's the details as required by the road traffic act and not your silly NIP. Also we are a bit dumb and two of us had the vehicle and may or may not have been riding at that time. Now guess the guilty one Middle Finger "
