Okay guys I have a question I need urgent response on. I've had a motorbike license for several years, but I passed my car license last year.

Law states If you got your license within two years you are a new driver. So With my license am I classed as a new driver or not?

The reason I ask is because I got three points on my motorbike for a speeding offense last year, now I have just got three more in the car, so 6 in total. And if you get 6 while classed as a new driver your license gets revoked, and I really don't want that to happen

Please advise, thanks

Sean

As I understand the complexity of it, if you get 6 or more points within 2 yrs it’s a retake. But yours may be a grey area, however as a full licence holder I suspect the DVLA will decide.
Let’s say it’s not the outcome you wish for, but wait and see.

As I understand it, if you hold a previous full license that's already past the 2 year mark, then no, you don't get relegated to New Driver status.

That’s my understanding too. If you already have a full licence then any tests you pass after that just add additional entitlements to your existing full licence, they don’t reset the timer.

It's from the date you passed whatever full entitlement you had first.

again just to confirm what others have said. It's from the date of your first test pass rather than for each category.

You'll be fine and keep your entitlement with your 6 points.

BCF is always right. Wub

The two year probation period with a six point limit is from when you first pass a test.

Road Traffic (New Drivers) Act 1995 says:

Probationary period for newly qualified drivers.
(1)For the purposes of this Act, a person’s probationary period is, subject to section 7, the period of two years beginning with the day on which he becomes a qualified driver.
(2)For the purposes of this Act, a person becomes a qualified driver on the first occasion on which he passes—
(a)any test of competence to drive mentioned in paragraph (a) or (c) of section 89(1) of the M1 Road Traffic Act 1988;

Oh right, so you could pass a moped test at 16, and your new driver status would run out at 18?
Every day a school day.

There is no moped test. Closest you can do is an A1 test at 17.

Really? I thought you could do one on a 50cc at 16, and if you passed it just let you ride 50cc's without L plates.
Maybe I'm out of date though.

You are right, there is such thing as an AM license which entitles you to ride a moped at 16 without L plates. The point in getting that license though is completely unknown to me. Seems pretty pointless lol

So there is! My apologies.

I think the only point would be it lets you take the L plates off and you can passengers, but presumably that's not going to be that fast on a 50cc.

But the point being .... It starts the 2-year clock running.
So for that, it is of use.
