Hi all

Really sorry to bore everyone.

But can I talk about V5 for a sec.

If u purchase a bike from a guy and the log book is still registered to the previous owner how does that work??

I know , tedious question but any advice welcome

I assume you mean:

Gentleman A sells vehicle to Bloke B, grabs cash and then slings V5 at B without bothering to fill in the details.

A has neglected his duties by not filling in the form.

B has no authority to fill in the form and post it to the DVLA and neither do you!

This is all very bad for Gentleman A as what would happen if, I dunno, you accidentally went a little bit too fast past a speed camera. Where would the fine go? And if A doesn't know where B lives and B doesn't have your address how is the fine going to get to the correct person?!

The "right" thing to do is contact the DVLA and say you've bought a bike and just been given the V5. They'll probably just tell you to fill it in and send it to them and everything will be fine Smile

Reminder, the V5 is not proof of ownership but I'd be very wary of any vehicle where the purported owner doesn't have his name on said document Shocked

If you have the V5, or even just the green slip, you can do it all online at the DVLA. Very simple process. If you only have the green slip, you can still use the reference number from that, as the full V5 document reference number will be the same, aside from the first number.

No need to send anything off to anybody, it's a very quick and easy process to do online.

I too would be interested to know why the 'current' owner hasn't transferred ownership to themselves as yet, especially with it being so easy to do.

Also, I would do the change of ownership before handing over the cash, as, if the V5 reference number, either from the full V5 document, or the green slip doesn't work, then the seller doesn't have the current V5.. At which point it's time to walk away, and, if you're conscientious inform the authorities

The tax is due on the vehicle as soon as you register as the new keeper too.

You can apply to SORN it which will mean you cannot keep it on the street or use it on public roads or places that the public have access to such as supermarket car parks.

The paperwork will catch up. But beware.

So if Bloke B has never bothered paying any road tax since acquiring the vehicle from Gentleman A, then if you put your head above the parapet now it's likely to kick off with DVLA who are going to expect payment of back tax. Probably not insurmountable for the OP to avoid, but potentially a lot of unwanted hassle nevertheless. The OP at least needs to check that on https://vehicleenquiry.service.gov.uk/

Buying a used vehicle doesn't have to be straight forward. 🤣

Many a kunt out there making things less easy for the unwary.

I think that's why solicitors are involved in property sales and acquisitions.

If you buy the bike then I’d get a Signed and dated receipt and, in addition to all the usual precautions such as meet at the sellers house, I’d jot down on it any details possible - address you went to, the Reg number of any cars that’s sat on their drive / lawn / whatever, phone number you rang, anything.

Surely until transfer of legal responsibility from Gentleman A to bloke B takes place online then it's Gentleman A who is responsible for any tax , SORN etc until that transfer takes place, and not the new owner.

This happens (or at least it used too) when any vehicle is 'in trade' so that the dealer doesn't add to the previous owners count.
It may be as innocent as that.

Either way, as suggested already, if you've bought the thing now you can do this s**t on-line and get it taxed or sorn (but do one) yourself today.
N.B. the dvla, or whatever they're called this week, are currently going after peeps for back tax/non-continuous insurance, so do something.
