To cut a long story short, I have been asked to look into & do a 'fact find' on an incident that a lorry driver of a company I'm involved with found himself in on Friday.

Leaving a regular drop at an industrial estate, he back tracked his route in, approached the mini island with an intention to turn right & whilst turning right a young lad in his hot hatch has smashed into the side of his truck.

Truck has about £15k of damage to both the trailer & the load, the car which was worth about £1k is a write off. Thankfully, no one was majorly injured, but I have no doubt the whiplash & bruised ego claims will be forthcoming.

My TM (transport manager) wants to buttfuck the driver, humiliate & then bankrupt him with the insurance excess & damages. Having looked at the scene on Google . . . If that sign is still there . . . I'm not so sure that our chap did anything wrong at all.

I've never seen one on a roundabout & especially never seen one on a mini roundabout. Have yourself a looksy & see if you can spot it.

Pointless sign and pointless discussion. You have to give way to the right on a roundabout and the give way sign requiries you to give way to people with right of way.

Probably because people treat it as a straight on rather than a roundabout.

You work hard for someone who has 32 bikes and fuck load of land. I'd take it a bit easy if I was that loaded.

Even if one of the entries to the roundabout doesn't have a give way sign above the mini roundabout sign, you still have to give way to the right. Without a dashcam proving the lad was going hell for leather and the roundabout was clear on the right, the driver is on the hook.

If the signs conform to highway code then they are far from pointless. What does your highway code say about giving way to the right on a roundabout???

If you're incapable of answering the question then jog on.

I have 32 bikes & a "fuck load" of your land because I work hard & I'm clever, I don't make too many mistakes & I'm definately not bitter & twisted.

I'm not sure what sign is being referred to, but as above, if you are infering that there is no giveway sign on that particular entry, then i can show you many other mini roundabouts without them also

15k of damage to a trailer and load from a hatchback at 30mph? Unless it was carrying a load of Lalique and the car had a landmine strapped to the front you are full of shit.

If the truck was far enough on the roundabout the car broadsided the trailer then the truck had been there a while, it's not like you can quickly try to nip infront when you are 40+ foot long, therefore it would seem likely the truck was on the roundabout before the car approached and the car driver wasn't looking.

Your fantasy transport manager is as moronic as you, unless his contract of employment specifies he is liable for the insurance excess and all damages then he isn't. If it did say that he wouldn't have signed it, there's a driver shortage nobody would sign that crap they'd go work for the next firm.

If it was real, truck would likely have a cam, most do these days it's getting hard to get commercial insurance without.

Your fantasies are getting weirder. I preferred the ballet dancers and corpses, least I could get hard to them.

Hate those types of roundabouts with a passion, many people just blast through them. Always quite cautious on the bike when joining the main road from the side road.

It's not clear from the above whether the car was coming from the left (ie, car at fault for not giving way) or the right (ie, truck at fault for not giving way)

As previously alluded to the insurance companies are going to make a judgement from where the impact was: lorry cab = lorry driver fucked up, lorry cargo = hot hatch driver fucked up.

It's very easy to assume the scrote was tearing it up at greater than the 30mph speed limit but unless the crash investigators are on the ball that information won't be there.

Nobody can help if you omit salient pieces of information. To prevent any other details getting lost, ask the driver to write down everything about what happened and draw a diagram of the scene.

There's an extraneous give way sign on the road from the right but aside from that I'm at a loss myself.

(Edit: for the left as well. This ties in with what I said about people treating it like a roundabout and not a straight road.)

Which side of the lorry did the car hit? If he twatted the left side, it's the car's fault. If he twatted the right side, it's technically the lorry's fault, but really it would be both their fault (the lorry for pulling out in front of the car, and the car for not anticipating/seeing the lorry pulling out in front of him).

Right of way on a roundabout is to the right - end of discussion really.

I think I'm right in saying it's give way to the right and give way to vehicles already on the roundabout. For example, a large lorry might have trouble getting around a mini-roundabout and be a bit slow.
