So your 'client' got unlucky by buying a BMW Boxer engine that likes to eat its own oil. Tell him to get to the back of the queue Laughing

But seriously - what you've said is nothing of interest; it's purely a pissing contest between your 'client' and BMW over him crying about having a whole new engine fitted when it could be a very simple assembly failure in the head having caused nack all damage.

In the UK we have 30 days protection under Consumer Rights Act 2015 whereby we'd just hand the bike back and say thanks very much BMW, but you can keep the lardy POS.

As above, in the UK, that would be a case of rejecting the whole vehicle as not of merchentable quality and returning it to whoever you bought it from for a full refund. It's the sellers job to sort it out with the maufacturer/importer.

No need to get a solicitor involved. Perhaps a slightly sharp phone call and a no-nonsense letter, which the government funded consumer rights section of the citizens advice beaurau will be happy to advise on the wording of at no cost.

Absolutely possible that it's a simple head component failure. Not catastrophic as your client says.
The machine may be 'un-useable' as is but if the dealer can repair to As New Condition' and the OEM coughs for it then a repair could easily be the simplest remedy. (If the client doesn't want to wait for a replacement machine.)

This is not catastrophic unless there's also collateral damage to the engine. And that would require an independent engineer to assess. Which takes time, is inconvenient and could cost as much as the repair.

But, as said above, all of this is redundant in UK if sale of goods act is applied within the time constraints.
Having 'accepted' is time based. But does not prevent you seeking redress if thing go wrong later.
An important point of Law is to report any issue to the OEM/Dealer and stop using the failed goods.
Continuing to use means acceptance.

..except K -series, I quite like those.

No one gives a shit about your video.

Hand the bike back, get your money back. If you can't do that, elect better politicians.

Regardless of the price of a vehicle, no-one is in the least surprised when a dealership fixes the problem by replacing the broken part, rather than by replacing more bits than are necessary. Either it works - then fine - or it doesn't work. Then you either get a refund, or get it fixed again, and again etc.

'Starting to blow blue smoke' isn't a catastrophic failure.

If the engine is still running there's not a great deal wrong and they probably replaced the head rather than trying to figure out if it was value stem seals or the value stems themselves.

Minor kudos to OP for having the balls to make a second post. However coming here with first post and blustering about some possible issue on a very expensive an impractical BMW aimed the 'new biker executive class' - that most people will despise, will not curry much favour with the wizzened contributors to BCF - As WD (et al) expressed so eloquently ..
