I'm sure I've seen this advice asked and answered here before but damned if I can find it, sorry... Have been googling too, for 'real-world' rather than 'insurance company' feedback again to no avail.
So - my son got rear-ended today while driving my car. No injuries, relatively minor (but expensive, obvs) damage. My son was stationary in traffic and apparently the third party was scrabbling around for a dropped phone rather than watching the road. So although no witnesses, hopefully should be 100% no-fault.
I'm just not sure how best to proceed here. Third party wants me to deal with his claims handler (a notoriously bad one on TrustPilot), who will deal with everything and give me a free hire car. I don't trust that an inch, so have turned it down. Just been completing the claim online with my own insurer, and have ended up with:
My insurer wrote: | As you are not at fault for the accident your no claims bonus will not be affected by this incident. You now have two options for your vehicle repairs. You can use the non-fault credit service which is provided by a separate company called Auxillis. Auxillis are a leading provider of accident services to motorists and would look to arrange repairs to your vehicle at one of their approved repairers.
In the unlikely event you make a complaint, not all can be escalated to the Financial Ombudsman Service but instead to an alternative dispute resolution scheme. If you choose to use the non-fault credit service through Auxillis, there would be no excess for you to pay and you are not committed until you have confirmed that you are happy after speaking with them. Alternatively, you can make a claim on your own policy where your excess would be payable. If at a later stage, the Third-Party Insurer accepts liability and we make a recovery of our costs, your excess can be claimed back. |
This seems pretty much the same thing I've just rejected from the third party, and I don't know what to do. Should I use this Auxillis outfit? My car's driveable now but I could do with a hire car while it's actually being fixed. Or do I forget that and just submit my own claim and then hope I can reclaim my excess (£360) from the third party? ____________________ KC100->CB100N->CB250RS--------->DL650AL2->R1200RS->R1250RS |

You'd have an accident to declare but no claim to declare.
Signing up for something that involves a credit service sounds like a bad idea when all you want is the car repaired.  |

Maybe at first he thought he had no injuries, and now realises he has strained his neck, needs time off work, specialist consultations, etc. He should see a doctor immediately. He's just been in a road accident.
Once his injuries have been diagnosed and a medical prognosis, outlook and course of treatment is clear, he should find a no win no cost personal injury lawyer at the earliest opportunity to recover from the other side.
Many of us have been through the process of dealing with insurance companies, accident management companies, unnecessary credit agreements, legal costs agreements, etc. They (the industry) have everything sewn up. It's a well-oiled money-making machine. You at fault? Other side at fault? Both? The only thing they make sure is that they're paid - it's all a game so they lose no money and screw over the system to line their own pockets. They aren't trying to help you. It's just a pile of self-justifying shit, like everything is nowadays. So the way forward, in my opinion, is to use your own lawyer, and recover damages. A lawyer costs a lot. Fortunately, you can recover legal costs as personal injury is involved, so you'll be able to find a no-win-no-cost lawyer quite easily. |

agree with that mate 100percent if you dont play the game the only lose will be you in a non fault claim and your lose out |
