Police bail???

I've not had dealings with the Police for over 30 years but I got arrested on Saturday for an alleged Public Order offence at home (big argument with a neighbour/nothing physical) and they also added common law assault to the charges for alleged aggressive verbal behaviour.

Anyway, after 17 hours in a cell they finally got round to interviewing me (solicitor present who advised me to say "no comment" to every question/allegation) and after giving my side of the events I was finally released without charge on unconditional bail but with an order to return to the Police Station in approx 3 months.

Why are they demanding that I come back in 3 months if they released me without charge???

Pure guesswork but technically they have to release you after a certain time if they don't have enough evidence to charge you. If their ongoing investigations come up with enough information to charge you, they don't have to go looking for you.

More realistically, to put you to an incovenience (like they used to do with 5 day producers for documentation they already knew you had) as a reprisal for appearing on their radar. Also so they can do you for something easy which requires no further evidence or investigation when you don't turn up (which I'd imagine a large number of people wont).

Because they haven't decided what, if anything, they're going to charge you with.

Or it's just to cause you a bit of hassle and a three month headache.

How do you give your side of the story whilst no commenting everything?

It's something I've just learned about called a pre-prepared statement. Basically you see your solicitor alone before the copper interviews you and in that time you tell him/her your side of the events and he/she advises you what's best to say and not say in the statement. He/She then words what you've said in a legal way that doesn't incriminate yourself unknowingly in any way and when the Police Officer starts his own recorded interview the solicitor reads out your prepared statement of the events you're being accused of first on your behalf with no interruptions from the copper.

After that you say no comment to all the coppers questions apart from initially confirming your name, date of birth, address if asked. I'm glad I took the solicitors advice because if I'd have verbally answered all the coppers sneaky and misleading questions myself I would've no doubt said something in the interview that I would regret later if they decide to take the matter to court.

The only thing i'm guilty of is raising my voice angrily and using a few swear words to the neighbour so it's all on the Police now to prove what they were thinking of charging me of when I was arrested due to the neighbours false allegations.

It's going to be a long and stressful next few months but hopefully the end result is "no further action to be taken". Fingers crossed. I'll never trust coppers again after this...

That is pretty much correct except for the timing of the presentation of the prepared statement. It is normally presented after the conclusion of questioning when you've learned what they've got on you and after you've had a brief discussion with your solicitor.

It was the other way round for me but the same principle I suppose.
Saying nothing is your best bet if you know you're innocent of the charges to begin with as talking to and answering questions from a crafty copper will probably cause you more problems than you've already got when you were arrested. As soon as I confirmed my name and DOB at the start of the recording the solicitor stepped in quickly saying she had a prepared statement to vocalise. She was brilliant.
