The new UK Online Safety Act law says they can scan all your private cloud files because they are potential sharing services between users.

tldr; relax. The EU still protects you. This is why Trump and Musk hate the EU. The UK’s Online Safety Act explicitly requires measures to be:

Compatible with other legal obligations -> like EU GDPR!

Section 11 of the OSA
https://www.legislation.gov.uk/ukpga/2023/50/section/11

UK law cannot override: GDPR

So: UK cannot force scanning of your private, unshared files.

Note: They can still scan your public or shareable files. Hence I am not having any shares in my cloud.

EU Court of Justice — No General Monitoring
EU Court of Justice bans systems that involve general monitoring, regardless of technique.

Scarlet Extended v SABAM (C-70/10)

Hashing is also surveillance.

There are morons in the UK that want to leave EHCR do you really think UK alone is strong enough to resist US oligarchs like Musk? Rolling Eyes

No, it doesn't.

What it does say is that file sharing platforms and cloud storage providers must assess the risks of illegal content and they must implement measures to prevent illegal content being spread.

One of the main measure taken to prevent illegal content is hash matching which is where a digital fingerprint (hashes) is compared to hashes of known illegal content such as CSAM (child sexual abuse material aka child porn) so the files can be removed before they're shared. Most people consider that to be a good thing, what's your opinion Val?

The UK is not forcing the scanning of your private unshared files.

Hopefully this Ofcom page provides an explanation that is easy to understand. https://www.ofcom.org.uk/online-safety/file-sharing-and-file-storage-know-the-online-safety-risks-the-rules-and-how-to-comply

Bad news. Laughing GDPR only applies to European Union member states and the three countries in the European Economic Area. As luck would have it, the UK has the UK Data Protection Act 2018 and the UK GDPR.

https://www.gov.uk/data-protection

So the EU isn't protecting anyone from anything. Wink

Literally what I have said:

Yes they can scan ALL your shared files. But EU law case I have cited forbids scanning and hashing of everything.
