Ok, so my insurance company (https://www.aquote.co.uk) is playing up with me.

I got my insurance from these, completed the forms and sent it off all in one envelope, paying the £130 deposit in the process - I then recieved a letter stating that my proposal form was not enclosed. Now they have cancelled my insurance.

I rang them up and told them, "I sent you all of the forms in one envelope, if you have the other forms (they do) then you must have recieved the completed proposal form aswell" - There reply was "Sorry, we dont have it."

Now the cheeky fekers have taken another months insurance out when im not even covered. Oh yeah, they sent another letter this morning asking for ANOTHER £70 for insurance i dont even have.

What can i do about the money they owe me? Surely if they have taken a months insurance money, they are obliged to cover me for that month?

Im not a happy bunny ATM - Theres no f*cking wonder some people drive/ride around with no insurance when they take the piss like these have.

Any advice/help would be great.

(edit) They said they could make me a new account, but i would have to pay the deposit again - I told them to go get ahem, yeah....

threaten them with legal action,, its amazing how quickly things get sorted out when you do.

ring them and ask to speak to the manager, then when you get to him ask for the telephone number for the FSA which you can make a complaint to

i had the same with mine, they kicked off and started fookin me about. e.g the woman spelt my name wrong even after 5 times of phoning and spelling my name out everytime! they decided to make my insurance start on sept 25 and didnt start the insurance till 16th october! still not recieved a certificate yet... cheers for the reminder Thumbs Up Thumbs Up

if you have home insurance you probably have legal cover upto £25,000 for this sort of thing if you mention this it will certainly make them realise you are serious especially since it woln't cost you anything to sue them.

i used to work for an insurance company, you can sue people for unfair dismisal, damage to your property and a whole bunch of other shit, i would guess an excess might not be worth it but you would not belive what you are covered for

sorted your insurance yet looney Question it took 3 weeks for my documents to come through for the nsr and when they arrived yesterday they had insured me for a nsr125f even tho i clearly stated it was an r-k Rolling Eyes f**king idiots. Any body else had problems with swinton insurance (swindle insurance is a much more appropriate name) conning t**ts charged me £31 for changing insurance to a different bike aswell despite having been with them for 7 years Mad Mad


oh BTW looney ive got my theory booked for mon 23rd may Laughing but apparently you have to do a hazard awareness thingy aswell Confused i dont remember the woman at RSJ mentioning that Shocked

Doesn't your household insurance legal cover, pay your bill for defending if someone takes legal action against you rather than pay for you to sue other people? If you want to sue someone, don't you have to pay a solicitor to do that for you rather than ask your house insurance company to sue them? Confused

i was going to use them (in burnham-on-sea) but the bird at the desk was useless, couldnt hardly work the computer and in the end i was telling her what to bloody do! (seriously i was Laughing ) AND THEN after ALL that hastle she only got quotes for 600 - 1750 quid, so i got the number of the insurance company my mate used (https://www.lexhaminsurance.co.uk/) and got a quote for £154 TPO + about £37 for extra cover (breakdown or somethin) which id say is WELL worth it total was under £200 which left me lots to spare Twisted Evil
all swintons do is look through insurance companys for you... and their crap at it so just do it yourself Thumbs Up

It can get complex because not only have you got an insurance issue, but you have entered into a credit agreement. Best bet is to get in touch with the Citizens advice Beurau or your local trading standards office, this is exactly the kind of thing they are for and they will advise you.

Stop doing it by phone, write them letters, send them by registered post and keep a copy then you have a record. First off send a letter detailing what has happened from your end (with dates), stating that you consider them to be in breach of contract, detailing what you want them to do about it (ie full refund) and give them seven days to reply. Keep the tone polite but formal, do not mention legal action at this stage but you can mention you have taken advice from trading standards.

This will establish the nature of your complaint and the action you want to be taken, it also put the onus on them to contradict what you have said in your letter. You may well have to write further, stronger letters but get it all down in writing to start with, this will stand you in good stead if you have to take legal action or make a formal complaint to trading standards or the insurance regulator.

You may be interested to hear it costs less than 50 quid to take a case to the small claims court and you don't need to have a solicitor to do it. You would have to show you had taken all reasonable steps to sort out the copmplaint first before going down this route.

EDIT: Oh yeah, stop the direct debit and write to them telling them you have done so because the transaction is now in dispute.

If you are under 18 the whole credit agreement thing leaves them on a sticky wicket as you cannot be held to honour a contract in law. Take advice on this from one of the afore mentioned bodies.
