Fortunately no blood but bloody annoying!! I was waiting to join the North Circular Road near Golders Green in North London, when a woman in a black Toyota shit bucket whacked me from behind. Luckily the impact caused me to drop the clutch and she pushed me into the slow lane of the road & nothing was coming. The back wheel locked and over I went.

I was not best pleased Evil or Very Mad

The damage includes scraped can, scraped engine casing, bent back brake pedal, also where she hit me, the indicator was taken off. After exchanging details, I got on the bike and it rode OK. Took it to LMC in Chiswick and the guys there reckon £500 to replace the scraped parts and brake lever.

A claim will cost me my NCB. So....advice time, do I ring her and giver her a choice. Say to her send me a cheque for £500 and call it quits or I phone my insurance company, the police and get her done for driving without due care and attention??

BTW I'm fine, just v. peed off!!

If it was 100% her fault, which it sounds like it was, you won't be claiming on your insurance, but hers, so it won't loose you your NCB.

stupid woman, what the hell was she doing applying her make up. i am a woman and even i get really pissed of at 'women' drivers.
i would call her up and give her the option, if you say police she may well give you the money but will probably want a written quote from the garage

hope you get it sorted out soon, seen as we are suppose to get a good biking summer

...but you need to notify insurers of every claim/accident (for the past 5 years!) so it'll be taken into account. There's also the excess you'd have to pay anyhow.

FWIW I'd give her a 'phone call, you have little to loose. Chances are having time to think about it she'll deny everything and say something like you reversed into her Rolling Eyes Point out that the liability is all on her, going into your you. The prospect of her not losing any NCB may be appealing.

Map, you may have a point on the accident records point, but surely there would be no need to pay any excess, because Headlamp would not be claiming on his insurance - the driver would have to pay the excess because it is her insurance as her fault - no?

i had a total write off on my scooter the lady admiteed it was her fault and my insurance didnt care coz as far as they were concerned legally i was in the right....

my insurance helped me get the payout from hers and bam bam i still got 3 years NCB and a payout

fone your insurance, explain and there is no way she can say it was your fault since she hit u up the arse.......

Thanks for the advice guys (and girls). I rang her - quoted £450 to call it quits otherwise I go for my 'uninsured losses' as well...she said that she'd get back to me. If I haven't heard from her by 4pm then it's with my insurers - as I have legal protection as well then I can claim for the stiff neck I have now, new helmet, jacket, boots, tear in my flourescent jacket & general disruption to my life.

Get to your GP and complain of a bad back due to the accident.

The £450 is just for the bike. You probably need another £500 of equipment replaced not to mention compensation for your injuries.

I'd go through the insurance, but don't take the piss inventing injuries and magically broken pieces of kit. It's not a magical never ending pot of money, it's everyones premiums which pay for it.

Well done for pointing that out! People sometimes seem to forget nothing in life is really free. But still they don't mind paying excessive amounts for insurance.

Headlamp, go through insurance and get your bike fixed. Might take a while but it's the best way.

I work with Mike106 and he suggested spending the afternoon in casualty because I have started to stiffen up. I can then claim for 'personal injury'. To be honest it's just 'old age' and pulling of the muscles as a result of the lurch when she hit me.

She hasn't called back so I will ring Bennetts this afternoon and go through the 'proper' channel. It will be her insurance premium that will be hit & I will get her for uninsured losses, being an honest sort of person I won't invent anything, but my helmet (maybe) did hit the road and there is a hole in my jacket and my boots are scuffed.

Go to casualty! If you need any witnesses, I can be where you crashed if you like? I saw it all, honest!

Still think you should go get checked out, I can see a whiplash claim coming on....

Don't exagerate any injuries or damage it's not worth the hassle. Give her one more phone call to pay up, she may have not told hubby yet, and then get a claim form. Claim for your jacket if it's damaged and the helmet if it hit the ground.

You still have to report the accident for 5 years when you re-new your insurance so if you can avoid this then it's always an advantage.

Phone her and give her two options

1) you do it all through the insurance

2) you send her the recipt and she pays it

She will go for option 2 because if it is done through the insurance the premium will go up, lose her N.C.B etc.

If the transaction os done through insurance this will take ages and they will charge you for all sorts of small things.

I'd go through the insurance. Doing it directly is a risk as you never know what hidden damage the bike may have, slightly twisted subframe perhaps?

A couple years back my Dad got rear-ended on a roundabout. At first it looked like a simple dent in the bumper, until he realised something was wrong with the boot not closing properly sometimes. The impact had done a lot more damage than that was immediately visible. Cost the other guys insurance £1250 Shocked

just go through insurance mate

as you seem to now want to take a grands worth of money off the woman which isnt going to happen


you will have to wait a year or two for a payout


but they will send you to a consultant and you can then play on it all you like


and then her insurance will pay out

Well, I have rung the insurance,have a claim number and mentioned my uninsured losses. She rang me to say that she'd be in touch with the police Shocked and they'd advised her to do it through the insurance.

I guess she reported that a stupid biker, pushed his bike up a hill, backwards, and then bumped into her front bumper on purpose then fell off. Anything else she's incriminating herself for driving without undue care and attention!!!

Its a shame when people try and wiggle out of something which is clearly there fault, as it sounds like she might try to be doing.

Remember to keep all receipts (even stuff like bus tickets which you had to use when you picked the bike up etc) and also, if applicable, the insurance excess invoice if you have to pay one as you can claim that back off her insurers as an uninsured loss.

100% she is to blame, let the insurance company sort it out. oh what about the whip lash that has suddenly appeared. It can take up to 4 days for the effects of whiplash to set in, go to your doc and say you have neck and back pain with headaches. Thumbs Up Thumbs Up

Mmmm, that's annoying....is it OK to report it tomorrow morning? I have left all the details of the incident in the office. I guess I could ring her tomorrow and get the incident number from her!!

........and just worked out that today is the 7th anniversary of me first getting on a bike!!
