A friend of mine is currently doing my nut in by constantly going on about how long he COULD be banned for. It would be the first time he's been banned.

I know the lenght could vary so here's why he might be banned. he's 18 and is on a CBT

1 = pulled and had to produce all his documents. failed to PRODUCE INSURANCE got 6 POINTS plus fine.

2 = failed to produce CBT. 3 POINTS plus fine

3 = pulled again and this time failed to produce insurance. he hasnt't been done for this yet. so he's on 9 points and awaiting punishment for no insurance.

How long do you think he'll get. I've told him probably 2 years. But he thinks he will only get 12 months, or if hes really lucky 6 months.

HOW LONG WOULD YOU SAY HE'S LOOKING AT BEING BANNED????[/b]

6 points plus a fine, thats bloody lucky for no insurance but effectivly means he is banned as soon as he passes the test anyway, if he goes up before a judge i recon he might end up with community service its not like he hasnt been warned before.

actualy i seem to recall someone saying to me that you can be banned as long as your points are over 12 and assuming he gets at least 6 that could be at least 2 years from the time he got the 1st points.

It'll be 2 years. Personally it should be permenant. Riding/driving without insurance is just damn stupid.

Ill probably get slated for this, but imo he should not be on a bike for at least a year. When will these irresponsible people learn. He has had enough warnings and I think the only way this guy will learn is by banning him for a while to ponder over his own stupidity.

Banned for life If I had anything to do with it!

No doubt with the legal system in this country he'll get away with 6 months and a small fine. Confused

You can get up to 12 points on a provisional without getting banned, the 6 point thing doesn't count yet. When he passes his test the points will become active only when he gets more points, at which point he'll get banned.

God knows what happens when you go over 12 points on a provisional, must take one hell of a muppet to achieve that Confused

Do us all a favour, take him outside, get him to lay down in the road and get a truck to run over his head a few times - that should sort him out.

I hate people who ride without licence, tax or insurance and can't be arsed to take a bike test... hope he enjoys a lengthy ban, all though by the sound of him it will not make ant difference and he we just get back on hie bike again. Perhaps a month in jail getting his a+se rebored in the showers will teach him a lesson.

How do you mean failed to produce insurance, is that couldn't be assed to produce it or not being insured? Because if not being insured he should be off the road for a long time!! IMO

He should have learnt his lesson the first time he got stopped!

He must also have been doing something each time to make the copper stop him!

Hi

Think the ban is actually quite short:-

https://www.freelawyer.co.uk/vlawyer/actfile.asp?seq=6&subject1=4&subject2=5

Suggests that it is normally a minimun of 6 months, but can be less.

All the best

I once didnt produce my documents (from an unknown at the time speeding offence and change of address). I didnt receive extra points just a large fine £280 and a M60??. Was a while ago now. So what im saying is even if you dont produce documents it wouldnt effect your points??

If hes riding on his provisional licence then he will lose this liscence and have to reapply and redo his test because you can only get 6 points in the first 2 years after passing your test BUT THIS INCLUDES POINTS GAINED BEFORE THE TEST!!

But due to a massive oversight, it is only triggered by gaining more points after your test. Pass your test with 7 points on your licence and you have a full licence, but gain one more point in the first 2 years and you will loose your licence.

To be honest I suspect that they just did not think about learners riding bikes and getting points when they came up with the 6 point rules.

All the best

Keith

I'm not sure what the actual law is on that, I had thought you did. But, if that is the case, why do they give out producers?

I think you have 7 days to produce your paperwork at any police station.

Hmmmm... I doubt that they would expect you to carry that. Just producing your license allows them to check on you and check for a stolen bike, no insurance etc. Like when I got stopped...
