No idea where this happened, or the exact situation, but it seems a copper in Derby has got away from a serious speeding charge due to convenient maladministration.

90 mph is excessive but I think it's fair enough the police can speed when answering a call, after all, if your wife/girlfriend/mother was raped/murdered, would you want the police to cruise slowly on over to your house?

His colleage said he was only doing no more than 55-60mph - in a 30 limit (you expect the police to tell the truth don't you Confused)

...and he still managed to crash because he couldn't avoid a car.

...unable to stop in the distance you can see, failed to anticipate actions of other, nice to see his Roadcraft training is up to date.
Wonder if he's ever received firearms training? (because that would have made him a better driver, wouldn't it? Doh!).

Does anybody know the circumstances before everyone jumps to conclusions?

One person who was in possession of all the facts said this......

He told PC Swain, who still faces an internal misconduct hearing: "You leave this court without any stain on your character or integrity whatsoever.

"If you were driving at 90mph, I could see why you would be criticised but there's no doubt in my mind that you were not."

Does this make any difference to how anyone feels?

Hi

Reading it, it seems from the "black box" that they knew he was doing 90 but it went missing and they were too late getting evidence from the suppliers that it was accurate so it was excluded.

Given that he managed to hit a house it suggests it was a more built up area that the one driven in by the copper around Telford (at a lower speed in a 30 limit), but on the other hand this was an actual pursuit. One thing that is not mentioned is whether he was some normal plod with no more training than any of us, or whether he had actually been trained to drive at speed.

Personally I do not have enough info to make a reasoned judgement. What is more suspicious is the way this case has been handled with important evidence going missing, and other important evidence being excluded.

well if its in derby most the roads there are quite slow arnt they? i havent even been there on my bike yet but iv seen maps of the place from arial view (multimap.com) and a few people i knew on the internet used to live there, from what iv heard its quite a built up area, doubt the copper had one bit of training and all his friends covered it up for him, coppers are a bunch of w@nker$ that all abuse their position Middle Finger Evil or Very Mad Middle Finger Middle Finger Evil or Very Mad Middle Finger Middle Finger Evil or Very Mad Middle Finger

Does make me laugh that the judge says he has no doubts he was'nt going at 90mph, hows that possible if the blackbox has dissappeared? was the judge watching the whole time?

Well with evidence in such cases only being available to investigating officers it must have been "misplaced" by someone, how unfortunate Rolling Eyes

Reading the report IMO Philip Yates started a manoeuvre, saw/heard the fire engine and stopped. The engine was travelling to fast to avoid the car or stop. Again IMO driver gets same as the police officer should have got, dangerous driving. Same comments on Roadcraft apply.

Although my cynicism is such that if this was a police vehicle and Mr. Yates hadn't died he would be the one charged with dangerous driving.

You have to ask, is it normal/safe to approach a Give Way at 40-50mph?

The problem with speed is that it makes you more likely to be involved in an accident.

So therefore a smash at high speed involving a Emergency service driver, reponding to a 999 call, is a lot more likely but maybe not always the drivers fault. People don't look about enough and often dont see the flashing lights etc until its too late.

When answering the call, the drivers are expected to drive as quickly and safely as possible. As i have no experience in "Roadcraft" i cant comment on his procedures. But answering a 999 call i believe he should get off.

Unless he was merely testing out the fire engine to see how it handled?

Bigger problem with a fire engine is that they are pretty damn heavy when full of water. Weight results in worse brakes, and one hell of a lot more momentum.

Wow that makes the second retarded post (Derby's network of slow roads being the first). Cars aren't on rails chimp, if you crash it's very likely your car will go off the road and into whatever's alongside it, ie. houses


Gotta say, I love the very last sentance about the other driver in the collision being prosecuted. It doesn't mention anything about the collision, who's fault it was and not one thing about the other car.
