I suppose it depents how thorough they are.
When my bike was tested a couple of weeks back, I sat on the bike and the tester told me what lights to put on so he could see.
One way to find out I suppose, sounds like it could be sorted quite easy though, just a wiring problem.

switch the lights to low beam and tape the switch up, it is then classed as having the lights permanlty on and should pass.
