ARGH, I ordered £177 worth of carbon stuff on the 13/6/05 and have still not recieved anything. They have taken the money from my account the day I ordered. I have tried to phone them but it just rings and rings and rings. WTF can I do? Neutral Mad

If you paid by credit card then get onto the card company and ask for your money back.

Also, try phoning them back after lunch. Smile

I've phone liked 20 times (not just today) and all through the day. It was paid by my bank card so came straight out of my bank. I will try phoneing one more time this afternoon but then what can I do to get my money?

ART will respond. Send them an email, threatening to issue a writ against them for money taken from your account - but check their T'c and C's first to see what they quote for delivery....

ART wont have gone bust...

Write them a letter.

Give them 7 days to respond before taking legal action. Make sure you send it recorded post.

If you dont hear anything then go for it. If you paid on credit card you can get them to claim the money back for you, just tell them what has happened and they do the rest. If you didn't, then www.moneyclaim.gov.uk is your friend.

Also seen on another forum where someone found out who owned the business next door to their premises, gave them a bell and the owner said that no-one was next door as they had gone under.

Are you sure they've gone bust? Done a search in the London Gazette and I can't find a notice.

I also can't find any trace of them at Companies House as a Ltd Company (unless they had a completely different name) which means if they have gone bust whoever owns them won't be sitting in his big house with a porsche parked outside, he'll either be penniless or missing!

If you haven't paid by Credit Card then you have no Equal Liability protection - your bank aren't legally liable if it's a debit card unless their terms and conditions stipulate that they offer this type of cover (and I'm yet to hear of one that does).

If they're not a Ltd Company then it is unlikely that Liquidators will be appointed as your claim is against the individuals that own the Company (whether it be a partnership or sole owner), of course if the individual(s) have declared bankruptcy then the likelyhood of you receiving a refund is slim I'm afraid.

I'm assuming you know where the Company is located so I suggest you try to contact the local Trading Standards Department within its' locality ( www.tradingstandards.gov.uk will be able to tell you the nearest one if you know ART's postcode - top right of linked page). As the local Trading Standards Department is ART's home authority then they will probably have received numerous complaints/enquiries from members of the Public (and other Authorities I suspect) in a similar position to you if the Company has indeed gone down the pan. They may have information on the current trading state of the Company and will be able to advise you on your next course of action.

YEY I GET MY MONEY! Very Happy

Bank have told me they will credit my account within 6 days then they will claim off ART. Either way I get my money back!!! Very Happy


Anyone know where else I can get a carbon mudguard, hugger and yoke protector for a zxr400?
