I thought I was getting rid of the NSR tonight, however, things never seem to go as planned.

Sunday night, a potential bidder came to Bassetts Pole to see the bike before bidding. They had a general lookover the bike, asked how the faring became damaged etc. All of her questions were answered truthfully and she seemed to leave very satisfied.

Later that night on Ebay, I noticed she had put in a bid that met the reserve I had set. So Monday came and the bidding ended with her being the highest bidder. We agreed to complete the transaction this evening, and all was going well. She took it for a test ride and seemed very happy. We did the necessary paperwork and she handed over the money and left.

About half an hour later, after advising her to fill up first, she came back wanting her money back because of the paintjob. She wasn't happy with and after some discussion, I gave her back her cash. She gave me £20 back to cover the cost of the replacement V5C.

Her argument was that the advert in Ebay did not mention the paintjob, fair point. However my argument was that she had come to view the bike before placing a bid, and therefore she was bound to buy it. She said due to poor lighting at Bassetts Pole, she didn't realise it had been repainted. It had been placed just outside of the beer garden at 7:30 Sunday evening, the paintjob was easy to spot.

So my question is, was she right to demand a refund or should I have kept the cash? I hate being in these situations, but I really didn't see us coming to a solution as it was 11:30pm by this time, so I gave her the refund.

She had the opportunity to look at the bike. If she felt there wasn't enough light then she should have arranged to look during the day. Sounds like she had second thoughts and used it as an excuse.

yeah i would have kept the cash too.
she had a change of heart
You dont have to declare things about the bike, especially things that are visible to the naked eye.

But you are a nice chap and so didnt want to feel like the bad guy.

At least she gave you something to cover your costs. I hope it covered the ebay costs too. and I hope you ended up selling the bike for more.

The thing is she really liked the engine and how it rode. We explained it had cosmetic damage, but she was under the impression it had been trashed and the paintwork was covering it up. How can you tell someone the paintjob was to 'cover up the damage I have already told you about' any other way? Rolling Eyes

You were in the right, if it came to court you would win. However you were just nice about it and she was a silly moo.

Bad luck, hope you sell it soon.

That's true, I hate feeling like I've messed someone over, even if I haven't.

£1300 for a mechanically sound, if slightly cosmetically impaired NSR is a bargain I would have thought. Trouble is I have had some interest from biketrader where it was also advertised, and told them it had been sold Doh!

You should have kept the cash. If it was a mechnical problem you didnt tell her about, refund no problem. But for paintwork she had already seen? Sod that.

That is a bargain. I just sold my P reg NSR (with slightly scratched fairings) for £1100.

Deal was done. Exchange was made. You should of told her to sod off.

The EBay sellers' fees are here.

Look at the Final Value Fee. If your bike hadn't been sold via EBay, you wouldn't of been charged this. You should contact her and ask for this too.

I won't have to pay the final value fees as I have told Ebay the transaction was not completed dur to the buyer wanting a refund. As long as she replies stating the same, I won't be charged.

Just had a thought though. I've now got to wait for a replacement V5 before I can sell the bike again Mad Unless I can get a V62 form for a potential buyer and show them the reason why they cant have the V5 there and then. Surely that's going to look dodgy though Neutral

I hope you all realise that I was there, therefore her, her mom and her dad left feeling very shitty. I don't like being messed about at the best of times, but chosing to do it to me at 11.30 after a few beers is really not very wise. I did tell her "sold as seen" and I was not giving her money back to her, but Fuzz is too decent a person to have agreed with me. As I see it now though, if we hadn't have given her money back, and she had a problem with the bike, could you imagine the shit storm? F**k her, I wanted to keep it anyway, and now I am.

Sorry about the rant, but if anyone knows this git girl, only one thing to say Middle Finger Middle Finger

All the paperwork is still in our hands and she only took off for half an hour, she couldn't even get it into first, I would be very surprised if she knew how to put it into a gear that would acquire a speeding fine, stupid bint!

Sorry, rant really is over now... Silence

I've spent most of today trying to figure out why I gave her back her money. I'm not going to beat myself up any more though, it's done now. Time to start stripping the NSR down and learning a little more about maintenance. Forks are first - I've ordered some new seals and we'll strip them down and replace the oil. Might even attempt a top end rebuild if the opportunity presents itself Smile

Edit: It went for £1300. I consider it an insult that she wanted her money back at that price.
