I went to a well known motorcycle dealer in Hastings a few months ago to buy a Honda SP2, he agreed to a test drive.

The bike was ok, but had a high mileage for the year, we haggled a bit and agreed on a price, gave him a deposit of
£500 pounds on the Sunday morning.

Later that day one of my daughters rang me to say she had bashed her car and that could we help her out.

I said of course, oops just realised , I had spent some of her repair bill on a deposit, without further a do, I rang the dealer
and explained the situation and would it be possible for me to have a refund for now, he said, no can do.

Cross or what, I contacted my solicitor, she replied, you entered a legal contract by sighing your name to the receipt.

I had no idea, of such implications. So beware folks, even a verbal agreement can set you adrift. I have latter heard he has done
the same thing to others.

Any suggestions as how to treat this dick. Evil or Very Mad

I'm sorry mate, but once you place that deposit you are agreeing to buy the bike and entering into a legal contract to do so. For all you know the shop could of lost another sale on that bike as it was 'sold' to you. It's not the dealers fault that you have pulled out - why should they lose out?

That is surely the whole point of a deposit? It is you saying "Keep this bike for me and don't sell it to someone else, here is £500 to prove I am not buggering you about."

You buggered him about, he keeps the £500.

Why are you calling 'him' a dick ?

You paid a deposit.

Deposits are normally non-refundable if you pull out of a deal of any kind. They're YOUR assurance to a seller that you WILL complete a sale (irrespective of what you've decided to purchase).

Is it really their fault your circumstances have changed ?

Try looking at it from their perspective. You 'promised' to buy one of their products, and paid a deposit to prove your honesty. Then, the seller sets all the wheels in motion regarding your purchase. Spending time and money ensuring YOU get the item you're going to purchase.

Then, you tell them you don't want what you've promised to buy anymore, and that you want your deposit back.

Forget it. Your on a loser from the outset.

And you think they're being unfair ?

Take heed. That's exactly what deposits are for. You pay for your promise. You pull out - you lose it.

That's the law.

Lucky them. But they weren't to know that, and it is entirely possible that they still had the bike now. We 'sold' a CBR600 about 6 weeks ago and took a £100 deposit. 2 days later the guy changed his mind as he'd seen another. He moaned when he didn't get his deposit back too. The bike is still in the showroom and has now lost more than £100 in depreciation. There were 2 people interested in the bike while it was 'sold' - chances are that one of them would of bought it.

saying this i went a viewed a bike that i am buying very soon i put down a 200 pound deposit. I also told him before i gave him the money im waiting for my loan money to come through and the guy was nice enough to say yes. i told him it will be another 7- 10 days and he agreed to keep it. Very Happy now just waiting on the loan money and vrum vrum zx7r Wink .

Also yeah if i was you countryhare i would buy the bike maybe find another way of getting the cash for your daughters car?

But, to the business you decided to buy a bike from...

Business comes first. That's what they're there for - to stay in business.

Forget your deposit. Just concentrate on your family.

There are far more important things in life than your envy of owning a bike of your choice.

Basically, you're complaining about not getting a refund, it's a legally binding contract which you've found out and then you say "family come first". .. that's fair enough but why moan about not getting a refund when you messed the dealer about to help your family?

Geeza, I have kids. They are teenager/early 20s, same age as a lot of people who post on here.

Whilst I know what you are saying there comes a point in your kids' lives where they have to take responsibility for themselves and their actions, and realise that they can't keep running to you for an automatic handout every time they screw up.

It's a hard lesson, and it's a hard thing to do. You love your kids unconditionally and like countryhare said, family comes first.

But do you not agree that a line needs to be drawn? Bank of Mum and Dad has to close at some point!

I bought my bike.
None refundable deposit, 10% of the bike's value.
Had I decided not to buy, he would have kept the 130 and I would have been happy with that, because that's how it goes mate Smile.

If you are putting down a deposit, put down the absolute MINIMUM you can.

I bought a £4.5K car last week, I held it with a £50 deposit.
