Saved a fall after being hit

A little while ago (not been on here for a while), I was coming back from London along the A12 to Ipswich and you have to go across Gants Hill Cross roundabout. I got into the left lane following the road markings. The missus was on the back with the intercom on. I start off in front of this silver Toyota avensis who was coming around the roundabout. I was in the left hand lane and he was in the right inside lane going around the roundabout and I was about a bike length in front of him at the start. He then decided, from the inside lane of the roundabout that he needed to come off the junction before I did so he indicated and went straight across my lane. While I was still in it. He hit the exhaust can about 1" from the missus's foot!

This obviously threw the balance of the bike off and I was impressed with myself that I was able to keep the bike upright with a frantic pillion after I've just been hit into the side.

We stopped, as did they. The missus jumped off and he looked at the bike then made that he was going to drive off but the missus stood in front of his car. Some guy in his car stopped and acted as a witness to the whole thing. I looked at my bike, a couple of scratches on the can and a scuff mark on the pipe. Not too bad I thought so I decided then and there not to bother claiming on his insurance. Looked at his car. The light and bumper completely destroyed. After we and the witness explained he had to give his details, he reluctantly gave them. The witness told him he was in the wrong and how lucky he was that we weren't injured.

And the bastard is making a claim against us! Even though he was very much in the wrong. Still, we're now counter claiming. Even though there isn't much wrong, a scratch is a scratch and to get a whole new exhaust system will cost him £1200!

Insurance companies are so slow though and though this happened back in August, they're still no further along with it. Should be open and shut in my opinion. I was ahead of him the whole time, he was in the wrong lane, he hit me, we have a witness and photos of the scene.

Sounds to me that its going to end up with him wishing he never tried to become the victim. What a twat.

Insurance companies are awful at these situations, but at least you have a witness otherwise it would just end up 50/50.

Hope it works out in the end and you get your shiney new exhaust.

Looks like you should have just punched his lights out and left him bleeding on the road as I bet that’s what he would have done to you and your missus if the whiteness hadn’t been there and stopped.

Still thoughts of stupid people and what could have happened out of the way I am glad to hear your both ok and oddly the car got the worst of it.

Still you where hit from behind and you have a whiteness to the fact and it is the cars front light and bumper that’s damaged so there should be no contest and the insurance should pay up.

My bet would be he got the bill for the repair and decided it would be cheaper to make a claim than pay for it himself so spinning some bull story to his insurance company.

I was more worried about the missus at the time (and keepign the bike upright). We tore the cable for our intercom (only a cheapo one) when she jumped off. She was perfectly fine though. I was the wreck after the event.

If i get all the money, I'll probably get a akraprovic full system which is cheaper than an OE version!

What is he saying, that you cut across him? Sounds cut and dried but he will be a devious git I bet. Have you still got the witness details etc? Get yourself an estimate for the damage and submit it, you never know he might retract it! Then claim against him

yeah insurence companies really do take their time, i got broadsided by a woman in a punto when she pulled out from being parked on the side of the road without looking. First thing she said when she got out of the car was "omg i'm sorry i didnt see you". Well the usual proceeding happened, the police were called etc and i was willing not to claim as it was low speed and all i had was a hole in my ankle where the car had slammed it into my slingshots cylinder, very little dmg to the bike(only thing i cared about at the time). But a week down the line i get a letter through the post from her insurers claiming it was my fault! all i did instead was file an injury claim and she dropped hers.

It took nearly a year to get to this point!

I know it sounds like sucking eggs.

But always take the details of some one that has hit you, there personal details and vehicle reg. If you have any witnesses get their details too.
Then let your insurance know to especially if it's not your fault. This will not affect your no claims if no further claim is pursued and pursued to be there fault. At least they will have all the info if these bastards out there try to claim, as it is a country of no win no fee claimers.
