I was caught speeding 2nite & they said i was doing 70mph in a 30 they saw me overtake 2 cars but they could not give me proof of me speeding there & thene any advice is it legal 4 them not 2 give u proof there & then

Yes if it goes to court you will lose your licence; a policeman's word is as good as anything.

You may be able to get away with saying you wernt the rider if you didnt have to take your helmet as the copper could never give a positive ID

Did they say they would be taking it further or radio it in, write it down, could have just been tryin to put the frightners on you?



Failing that you would have to try to get a couple of points off your license first you can appeal for them to be removed, but this is highly unlikely as you have just been caught

But driving without due care and attention or worse dangerous driving could be the charge.

'Notice of Intended Prosecution'. (From personal experience) A yellow slip of paper which give the details of the incident. You sign it and take it to your nominated cop shop with your paperwork and it's taken from you and processed by the court.

How long have you had your licence?
If it's less than two years (and you get 6 points or more) you can wave bye bye to it, but you should be bale to re-apply right away.

It's worth noting that this 2 year restriction is applied to the licence, not category.

I had my car licence for 3 years before the bike, and had 3 points, I then gained another 3 on the bike totalling 6, but I got to keep it.

If they gave you all the relevant paperwork, it's probably best to take them. Going to court will only cost you much more money and it will always be your work against a copper.

I would strongly recommend against doing this. If you get found out, it could end up with you being charged for attempting to pervert the course of justice which is a little bit more of a serious charge.

By the sounds of it, they've either pulled you to warn you or they have already issued a notice of intended prosecution. (NiP) If you are taken to court there is a high probability that your licence will be revoked as you were over double the speed limit.

Hi

They need the corroborated opinion of a police officer as evidence to do you. That means one police officer deciding you were speeding and using a calibrated device to confirm his opinion, or checking with the opinion of another officer.

70 in a 30 is likely to be an instant ban irrespective of the points on your licence (30mph over the speed limit is the general cut off point at which you get a ban).

If you were doing 70 in a 30 then well, what can I say.
Couple of nights ago I was riding home, taking it steady in a 40 coming into a 30 when this mad idiot came up behind me from no where revving loudly, he swerved out passed me went like f**k diving in and out between the cars and straight through a pinch point where my nephew was run over a few yrs ago (he is ok now), I would not like to say how fast he was going but he sure made me realise why it is that bikers are so disliked, I thought he was just a tosser and was most annoyed by his appalling riding Evil or Very Mad

Depends on the situation as to whether you get a choice. A fixed penalty should not be offered if it will result in a ban (think it is different for the 6 point revocation of licence limit for a newly passed rider / driver, but not sure) so you would have to go to court.

If you are being offered a fixed penalty of 3 points and a £60 fine it would probably be best to take it. If you are being taken straight to court I would go for a Newton hearing to get the speed below the 59mph threshold. You will still lose your license assuming its a new full recently gained one but you will be able to resit the tests immediately and it won't appear as a ban on your license.

You need to make clear to us what type of license you have and if full when passed.

First thing did the Police give you a NIP? You may have answered it but I must be getting old as I am fucked if I can understand 50% of the above.
If they didn't, you may have got away with it!

If they did ....well your fecked, even if you took it to court they are going to believe the officer before they believe someone with a licence full of convictions. Me thinks its time to re-take your test and remember to pay the nice insurance man extra money as you are now a High risk!
