Small tax problem.

I'll start from the beginning.

A mate of mine bought a dt125r with the intention of getting a licence etc... But two weeks after he got it, he got arrested and was placed in custody for 150 days and his bike was impounded. Anyway, he's now out and is getting the bike back on friday.
He's agreed to let me ride it about for a bit while i sort out my cbr, my insurance covers me on it tpo, and it's an 04 plate so doesn't need an MOT. But he's got a feeling the tax has run out.

So, my question is, can me and him go down to the PO and get tax for it?

If not, how do we go about getting tax for it, without him having to get a licence/insurance.

Also, if i ride it about with no tax, who will get the points for it, him or me? Because it's his name on the log book.

Hi

The vehicle needs to be insured to get tax, while your insurance will only cover you to ride it (so technically it is not covered by your insurance when you are not riding it).

Basically he needs to have the bike insured for you to ride it. His licence doesn't matter (beyond making the insurance expensive).

Don't think a lack of tax is a penalty point offence.

Your insurance will only cover you if he insures it himself otherwise you will have to take a policy out for it and use that.

Hi

Dom_, that is correct. You are covered to ride a bike you do not own. Problem is that the bike itself is not insured and it must be when on the road. Do not think that is an issue when you are riding it but when it is parked it will not be insured which is an offence.

For example. You park the bike at The Wheel and it falls over causing a domino effect. You are not riding it so your insurance will not cover it, yet legally the car park is part of the highway (think) and it must be insured to be on there.

This isn't legally correct but another one of those little insurance white lies.

The vehicle is not strictly insured the person is to drive the vehicle and this grants cover to the vehicle. The vehicle is insured when it is in your custody. The wording on insurance notes has changed slightly every year till it got to this point.

There is nothing in law that states you cannot insure or tax a vehicle that is not in your name, if someone knows otherwise please tell me.

Something I read years ago said to take a letter of permission from the owner of the vehicle to a vehicle tax office, not a post office and argue the legal point there as they will normally grant a tax disc. Whether this works or not I don't know but nothing in law that I have read states otherwise.

I'd double check your policy booklet / small print or ring your insurers to be sure.

also if its not taxed and you get caught on the road you get done as its under your supervision.

I would see if you add it to your insurance, that way you will get a cover note etc and you wont have to worry about it.

you can not get tax without insurance but if you know somone with a van you could pick it up to get it back home and off the road but then tax it when he gets a lisence / insurance

You can, and often adding an extra bike is cheap. However many insurance companies refuse to insure a bike that is not in your name (no legal reason why, although you could argue that if you are insuring it to ride then you are the legal keeper and should have the bike in your name).

My insurance allows me to ride anyone elses bike TPO as long as the bike is insured by the owner.

Surely, this will apply in most cases ?

If the bike is not insured in the first place by the registered owner, then your cover to ride such a bike will be invalid.

Nevertheless, ride a bike or drive a car without TAX and you're liable to a fine anyway Rolling Eyes

However, you might get away with saying you're taking it for a test ride prior to buying it Thumbs Up Wink

Does your policy actually state this or does it say something along the lines of what Dom_'s says?

I have to disagree with you there I have not seen a policy with that on yet, although they may exist.

Dom_ check your policy but you will still need to sort out tax, the easiest way being to insure it yourself.

Sickpup if you right i can go out and insure a battered old GS750 or similar and then buy a spanking new R1 and put it in a mates name and be insured to ride it, I dont think so.

You can, but you need someone else to insure it so you can tax it and have it insured when not in your posession. Used to be quite a common trick.

I've looked at many policies what with the fact that I used to run a hire company where the riders generally provided there own insurance although I used to keep 7 policies spare for riders without.

Now get off the high horse , stop repeating the shit that many have before and back it up.

Dom_ can ride ANY bike that he is licensed to ride on his policy as long as it's legal. It doesn't matter if the owner is insured as Dom_'s insurance as stated on Dom_'s policy doesn't have the requirement for the owner to be insured. If it did it would state it on his insurance.

And if the crap you just spouted was true how the fuck did I hire out all the bikes I did as my insurance is on me and not a vehicle? In fact I still retain this type of policy so are you saying that anyone who borrows one of my bikes is breaking the law?

My Xj policy said something to that effect, that the bike had to be insured by someone else before I was.

So that you can't buy a c90, insure that and ride whatever else you buy....

Think it also doesn't count if it's registered in your name.

So if Dom_'s policy is the same as mine (which from the wording it isn't) then he wouldn't be covered on the bike, and therefore couldn't tax it.

Never seen wording stating that on any policy I have had. However in the wording of Dom_ s policy he is insured to ride any bike he does not own. Doesn't mean it is insured when he is not riding it.

you may be right. Although i have seen it where it has been stated within the policy that the vehicle must be insured by someone else, although this is not the case with mine Embarassed
