Right, last month the company hit some bad times and they didnt pay the account managers. After a little uprising, they secured some cash and paid them, albeit late.

Now today is payday and surprise surprise.. we havnt been paid. Not only have the account managers not been paid, but nor have ANY of the staff, myself including.

Checked with the bank, and they said that even if it was due to go in monday/tuesday, it would appear on the system today, but it isnt there. Suggesting that it hasnt been keyed into BACS systems.

If they dont key it in by 12 noon today, the earliest we will get paid is next Thursday/Friday.

Now ive got a couple hundred left, but not enuf to last me another week. Especially not with bills and rent being due in the next 4 days.

Just wondering where we stand legally on this. Am i correct in thinking that it is Breach of Contract? We have signed contracts to say they will pay us on the last working day of each month. They have failed to do that twice running (although its only this time that is has in fact affected me).

Advice please?

Otherwise have a word off the record with some of the managers/boss/accounts team , to see whats going on to see how bad the bad patch really is.

Babyyam though always tells me when I have job woes (thats when I have a job) to go look at ACAS

What payments can an employee get when their employer is insolvent?

Employees who have been dismissed can receive payments of certain debts (within limits) owed to them by an employer who is formally insolvent, as defined in the legislation, from the National Insurance Fund.

These debts include:

* arrears of pay for a period of at least one week but not exceeding 8 weeks in all

ie you can get up to 8 weeks pay back but not off the company itself but off some sort of government insurance scheme.

which means you can keep working for another 4 weeks and still have right to claim it back , or look for another job, though the work you've done you can claim back , I think

I've been through this with my last company and I think it's not a good sign.
The company has probably started by not paying any suppliers if they're short of cash. Then the payroll gets cancelled which should be a very last resort. It sounds a bit worse than a simple cash flow problem.

You're legal rights aren't going to help you in reality because what you need and want is cash in your bank on payday, now or as soon as possible!
Talk to acocunts or the boss - who really should have explained the situation in person and said when you will get paid. which will probably be by cheque now.

ask for cash and pay slips for this , companies in trouble may issue rubber cheques , the company I last worked for was in trouble and the staff always got rubber cheques , they are in even worse trouble since their three biggest rivals formed an illegal cartel to undercut the prices my ex company was selling things for.

and whence you get such cash check if they are real as I've had previous bosses who have recieved iffy cash try to get it out the company via payroll.

theres an anomoly in UK law , that allows companies to open subsidaries holding 100% of the shares and share capital , they do this to open up risky ventures in risky but potentially profitable markets.

If they bugger it up they liquidate the company and the parent company just loses all its share capital , but if its sucessful they merge into one company.

Its quite often used as it keeps the assets of the parent company pretty safe.

yes it's a breach of contract but would have thought someone with your brain would have seen the fact they were struggling and get out quick?

BACS payments take three working days, we put all our payrolls through on a tuesday and they get paid on the friday.

Get another job quick!

The minute any employer either starts paying late or not paying at all, they must have big problems.

The company doesnt bank with HSBC does it?
When me mum came home from work she said that a computer at the HSBC has gone down and a few thousand companies wont get thier wages etc payed untill after the bank holiday, hence why she hasnt got paid

when this happened b4, we suggested that you cut back on your spending as your company was in trouble and that you should get another job

i suggest this again, and if you arent gonna be able to pay our rent, take out a loan to tide you over, but stop spending everything

the last thing you want to do is piss off your landlord by treating him as a credit facility

Mate, ur the pedantic little shit, not me. Ive checked your company out too -before your domain name changed/ran out. Would appear your consultancy wasnt doing to well either Wink

Im landlord, but my dad is the legal owner of the house. Like i said on that other conversation, when he dies THEN the house becomes legally mine in its entirity.

At the moment its my house to rent out to people as i feel fit, i collect the rent, i pay my dad a small cut out of what i make, i pocket the remainder.

Mark, no mate, im not a Business Consultant. We DEAL with business consultants. As for the issue with HSBC, thats what i was told by the bank which i bank with. We were paid at 4pm on friday in cash.
