court cocked up endorsement on licence... what to do?

licence was endorsed 10/05.

offence took place 08/04

it took CPS 14 months to deal with the case as they lost my original insurance certificate and generally made a balls of it - I was seething when I was eventualy convicted... so wishy washy..

anyway -

they have endorsed the licence with a date of offence 08/05 instead of 08/04....

Can I appeal to have it completely removed? or does it just get corrected by the court?

The endorsement will start from the date your case was heard in court, 10/05, not the date of the offence. Basically, endorsement from date of conviction.

thanks for your reply, but I understand you're incorrect.

endorsements timescale for eligibility for removal from licence begin on the date of the offence, not the date of conviction.

I've spoken to my brief and the court and I need to send it back to DVLA... I'm sending it back in any event to have the new A category applied and to have expired endorsements removed, so it'll all be done in one go.

You are right about the date of offence, I know somelse with simlar problems.
Make sure you keep a copy of your licence before you send to the DVLA who are suspected of have waste paer bin for a letterbox!

Not just a copy. A CERTIFIED copy. Make a copy and get someone of 'good standing' to initial each part of the copy then write the following on it:

I certify that this is an accurate copy of the original.

Name
Signature
Position
Address
Date


A plain photocopy/scan is too easy to tamper with and the DVLA will not accept it as evidence of them having fucked up. A certified copy is admissable as evidence if it was ever to come to that.

Do not let the copy out of your posession in the case of a balls-up, they can look at it but only when you are present. Things get 'lost' too easily in that government department.

My apologies carlos, I have obviously given bad info there. I am thinking of criminal convictions.
