Got a letter today from a credit agency about a barclaycard balance i neglected to pay during my house renting days about 6 years ago, is there anyway I can get out of paying it. Wink

First thing I've noticed is they havent even spelt my name right can this affect anything?

Just pay it. They're found you, and next there'll be a knock on the door. It'll also affect your credit rating.

another year and it gets written off

I had a credit card, needed another 6months before 7yrs were up!

but the missis put my name on the council tax!

Week later, letter on the door!

They've already found him though, so they won't leave it a year.

Just pay it, or you'll have the bailiffs round. First thing they'll take? The bike.

The have found you, and don't think there is a limit time wise. It might be the first line collection agency which is probably a subsiduary of Barclays.

There is definatley a limit of six years, but thats a limit of six years with no contact.

FIRST THINGS FIRST - RETURN THE LETTER NOT AT THIS ADDRESS

Don't call them, don't answer the door to any "officials", if the bailiffs come round and you don't let them in they can do sod all. If you tell them to p*ss off they will.

You can get someone else in the house to call them and say there was an argument about 6 months ago or something and you left and they haven't seen you since. It'll get written off

There is no legal limit on collecting debt. The creditor can write it off after 6 minutes if they want, or pursue it forever.

"Not at this address" will generally get a personal call if the agency have anything about them, or their %age is high enough. They may put a private detective onto it.

The bailiffs can't come round unless the creditor has already obtained a court order.

If someone else in the house tells them you have left they will normally return the debt to the creditor, who may choose to write it off but more likely will wait for a bit then sell it on to a different agency.

as there credit rating would be next to useless anyway.

i work for a bailiff company in the north east and it is correct we will only knock at the address if we have obtained a court order

and yes sending the letter back (no at this address) or telling them that person no longer lives there does work for a short while

but we now check with other residents in the street

we also check credit history (ie resent loan or bank account application etc)

also some companies (the one i work for) adds additional charges on for sending letters attending the address and credit serches

my advise would be to pay it as soon as posible

The Limitation Act 1980 sets out the rules on how long a creditor has to take action against you for a debt.

Unsecured Credit Debt
This would include credit cards, store cards, bank and building society personal loans, catalogues, finance company loans etc. You may have had a debt with an ordinary unsecured creditor that you have not heard about for a very long time. You may have moved address or thought the debt had been written off.

Out of the blue a letter arrives from the original creditor or a debt collection agency asking you to make a payment.

You can argue that the creditor is out of time or “statute barred” from taking you to court for this debt:

if

The creditor has not already obtained a judgment against you
and

You, or any one else owing the money (on a debt in joint names) have not made a payment on the debt during the last six years
and

You have not written to the creditor admitting you owe the debt during the last six years.

yes but would tring to claim back over 2million + in court costs and fines from people who have been done for dealing drugs / drink drives / etc more than make up for the very minimal work that we do chasing people that only own money to credit card companies etc


my personnal opinion is that i would rather try to claim this money back than have to pay even more on council tax ect

I havent paid off my debt, and never paid off for that laptop i got from curries Laughing Laughing that stands at about 4.5k in total, used to get a letter every 2 or 3 days from debt collection agency, then it would be a different agency the next week.

Never phoned me once and the letters stopped coming through the door after i spent 2 weeks writing ' addressee not known at this add ress '

What can the bailiffs take from me? A computer that was out of date 2 years ago, a 8 year old 14 inch TV, a 6 year old BUSH VCR ? or a stereo which only plays on the radio setting, or a fucked 2.0 fiesta which they wouldnt be able to get it off the drive as id put it on bricks and disconnect the engine loom so it wernt going no where !
