Bike written off?

I got taken off my R6 2 weeks ago, reported it to insurance who said they would be treating it as a 50/50 no fault claim.

The bike got picked up and taken to a garage on Saturday, just spoken to them and have had a verbal quote to repair that is a grand more than I paid for the bike.........

Phoned the insurance people up, they have passed my claim to a 3rd party, I phoned them and explained the situation, the 3rd party has told me to phone my insurance company again to see if they will claim from the car driver.

If this goes down to insurance, I will only get half the value of the bike, and will be unable to replace it, has anyone got experience of this, or any ideas about the most sensible course of action?

In this case it would have helped, however in a lot of cases it comes out that you lose money even if you make a claim!

First thing, were you at fault?

If you weren't and the insurance company is treating it as 50/50 you should be able to make a fuss.

Not an expert on such things, but I'm sure someoen with more experience will be along soon enough Smile.

I actually thought that if repair costs were more than the vehicle is worth then they would just write it off (obviously there may be some exceptions).

Accepting 50/50 may have dropped you in it - obviously don't know if you could';ve pushed for it being car drivers fault?

If they write it off then you only get a certain amount of pay out from car drivers insurance (like you said) but if they repair it then you gona have to fork out for most it :-/

I know it seems a lot of money at the time but next time pay the extra £300 or whatever it is for fully comp.

Are you being claimed against? It might be cheaper to not claim and repair it yourself.

I've had nothing through the post to say I'm being claimed against (yet).

I basically filtered through traffic then moved back into the flow of traffic, as I did so the car moved into my lane and hit me(dual carriageway). In my opinion the car is at fault, but I have no witnesses.

Would it work out cheaper to claim aginst him, then buy the bike back as damage repairable?

Nah. Depending on how strong you feel that the car was at fault get back onto your insurers (or theirs) and tell them you don't agree 50/50.

Did you speak to driver at time and get an admission of fault from them? If you can get them to admit liability then retract your claim from your own insurance and do it all through theirs (keep your own no claims). This may mean having to go to a garage approved by their insurance but tell them you want it repairing rather than writing off?

If you are TPFT you won't be able to claim off your own insurers you will have to claim off their insurers. Did you pay for legal cover with your policy?

Got the policy from ebike, legal cover is included.

There is a phoneline for legal enquiries, suppose ringing that should be my next step?

Yep, phone them up. They will act as your solicitors and deal with the third party insurers on you behalf. Keep pressure on them for constant updates, to keep things moving and stick to your guns unless it's looking like a completely lost cause.

Oh and don't give up hope, I had a 3rd party claim that took 9 months, but I got a 100% settlement in the end.
