ello,
Nice little surprise in the bank this morning, I've been paid 350 quid more than I should have been. I'll have to confirm when I get my payslip but I reckon what has happened is they are still paying me shift allowance, but I have moved off shift. This happened last month but I thought nothing of it an just thought it was back pay, as I have only recently moved off shift.
Now the question is, do I let on to them? If they find out can they legally try and claim the money back off me?

Depends on how honest you are.
They can indeed get it off you if they want, and it'll show up when they next try and balance the books.
I'd tell them their mistake and see what happens.. but thats me, and I'm honest  |

It's the internal struggle of greed vs. honesty, and greed is winning at the minute
I had considered sticking it in my savings account and earning interest off it, and then if they ask for it back I have it there ready to give back?? ____________________ My bike |

I think this is probably a good idea. I think they do have a right to ask for it back(It's happened to my brother before), so when they do, just pay it back to them...At least you've got the interest out of it. ____________________ BMW R1200GS & Honda Fireblade 929RR

Are you sure there wasn't some agreement that they'd continue to pay this allowance for a certain period?
Some guys at our place went through that - moved from shift work to days (meaning a drop in wages) but they got an agreement where for 3 months they would be paid shift premium on top to allow them to settle any financial issues it would result in but also to give them time to adjust.
Perhaps your company does it as a matter of course? If you're not alone in the shift move then ask your colleagues what difference they noticed. ____________________ We live in an age when unnecessary things are our only necessities  |

One part of my role is payroll manager, and legally this is where you stand...
If they notify you in "reasonable time" in writing or verbally within say 1 week that they have made an error, you need to pay it back, however if it goes unnoticed and continues, the emphasis is on you to inform them.
Basically as you are still employed by them, honesty would be a better policy, if you had left, leaving.....if they have not informed you within a week, then legally not a lot they can do, been there many times when people have been overpaid and if they are too daft to pick it up, generally they will leave it.
If you get it next month, and are honest by telling them, then obviously they may check back to this month as well, be honest is best answer because they will pick it up when they reconcile next month or the month after etc. ____________________ Always believe that your guardian angel flies a bit faster than you............... |
