Traffic may stop to let you out, but it is still upto you to ensure that it is safe for you to proceed.
Filtering is a well argued point on these forums and it is the responsibility of the driver pulling out to ensure its safe to do so.
I would also add that if its you filtering it is also in your best interests to ensure that if you see any gap in the traffic you are filtering passed that you slow down for just this reason that someone could pull out.
I would say it would depend on the examiner and the exact way you handled the situation as to whether they would deam it a fail or not. ____________________ Just because my bike was A DIVVY, does not mean i am...... |

Thanks for the reply. What happened was that the traffic lights at the main road were on red, and the traffic was backed up further than my junction, but leaving it clear for me to pull out safely, as the part of road was boxed keep clear. So I pulled out, doing all my checks, and then as I was about to straighten up on the main road to proceed, the car decided to jump the queue.
