I am after peoples thoughts on a new form of legal expenses insurance that is about to come onto the market and will be available through a select number of outlets and which could replace Legal expenses Insurance (motor) as we know it.
First of all the product is absolutely "FREE". The insurance product indemnifies an individual and their family against the cost of legal litigation.
It also covers any passengers in or on a vehicle which is covered by the insurance.
It covers road traffic accidents, accidents at work, accidents in a public place and when playing sport.
It can be targeted to specific groups as a scheme product such as bike clubs, dealerships for their customers or special interest groups such as members of a forum like this one.
Reciprocal arrangements can be provided for the repair and hire of replacement vehicles in the case of road traffic accidents.
There is no catch.
Unlike some schemes that are currently available, the scheme only uses approved law firms who have had to show that they are above a conveyor belt type law firm and are not simply an accident management firm, and the scheme will run exactly the same as it would if you were to instruct solicitors on a Conditional Fee Agreement (No win no fee).
The biggest bonus over a normal LEI is that with someone like DAS you have to go to the law firm appointed by them and in some cases you may get a non specialist firm or as mentioned a firm where you are simply a number on the conveyor belt.
The insurance company underwriting the project are a recognised player, and the reason the product can be offered for free is that with the normal risk assessments that are carried out, there is a better than average chance that the case will be won and the legal and insurance costs will be born by the other side.
I have gone through the small print with a fine tooth comb, and I really cannot see any catches. It is free, it covers members of the family and vehicle passengers, it allows you access to legal representation as a group scheme, and it could save you money as you will not have to pay the LEI premium as part of your motor insurance (even though they say it is free, you still pay).
I will be going out over the coming months and talking to groups about the scheme in more detail, but I would be interested in your initial thoughts bearing in mind that I cannot cover everything here. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |

It only ties people into a law firm who is on the panel but who has been vetted, and no commision is received, it simply ensures that the claimant can have legal representation free of charge, without risk, whereas someone like DAS appoints solicitors who will do the work for a reduced fee and then make sure that the cluient jumps on the conveyor belt.
The way to know if a law firm is decent is to look them up in Chambers https://www.chambersandpartners.com/

That is the benchmark, and if the firm you are considering appears in either of those two journals, rest assured they are a decent firm

I here what you are saying, and I will try and clarify the points you make.
Yes it is an insurance, but more an after the event insurance designed to protect the claimant against any counter claim, or in the event that they lose the case it will pay the third party costs.
Like a Conditional Fee Agreement (no win no fee), the case has to be risk assessed before it is accepted, and there has to be a slightly better than average chance of success in winning the case.
Even with a CFA, the client has to be asked if they have legal expenses insurance as this is often the prefered way of funding a case, and then the CFA becomes the second option, with this new policy, it avoids that.
The value is that it could avoid someone having to fork out many thousands of pounds in the event that they lose, it will avoid the client being asked to cover the costs of disbursments if they lose which some law firms still do, and it means that the client can choose a firm that is perhaps local to them.
But it still does not get away from the fact that the case has to be risk assessed before it is accepted, and inevitably there will be some cases that will not be accepted for whatever reason.
You could reason that you are only going to be allowed to choose from a list of solicitors that you are told are good, but the Chambers and Legal 500 directories are put together by totally independent people and a whole host of criteria are used before a firm or individual is entered inthe same way that I had to be vetted and recommended and my work assessed before I was entered onto the Law Society Panel of expert witnesses.
What this will do is allow people to save money on their motor policy by not being obliged to have LEI cover at a cost of £10 or £20 and even more in some cases, and unlike some LEI policies there are no exclusions.
I have just been asked if this policy would cover motorcycle racing and track days, and having checked the document and exclusions, and subject to confirmation, it would appear on the face of it that it will cover these activities.
The other thing that differentiates this type of policy to those written by the insurance companies is that the policy was written up by a Barrister and solicitor so it covers every eventuality which is often not the case with other policies. ____________________ It is better to arrive 30 seconds late in this world, than 30 years early in the next |

A very wise man, aka my father, once told me there's no such thing as a free lunch.
So, following the money, how does this work? Is there any reassurance it's not a reinvention of one of those loan type accident no win no fee that were all the rage a few years back?

Forgive my scepticism of the legal profession but they do nothing for free, there's always a payback. Very few do any real pro bono publico work. As for anything written, there are always getout clauses, or to put it another way, so vague and woolly wording it's useless.
Having said all that I commend you asking the question for feedback On the face of it it sounds a good idea, but the as said the sceptic in me keeps saying nothing's for free.

Theres at least 1 company in the second link I wouldn't piss on. Some of the shoddiest work practices I have ever seen including not putting claim money aside to pay for storage of customers bikes but giving it to the client instead so the storage facility has to sue the client, asking questions that shouldn't be asked and then when not answered suggesting a vehicle assessor commits fraud.
The company I use is in the first link though and they are good. |
