I purchased this bike in feb/march from a local garage and had asked if the bike was hpi clear. Being a garage owner i trusted him as i expected he would of checked it himself before buying the bike...
The bike is coming up to its MOT and i noticed that the previous mot had a different VIN number to the V5 so i check on the net and the V5 VIN number is registered as stolen/recovered and Cat C write off.
But on the bike now, there is a different VIN number which is not registered to the bike (not on V5) and looks like it has been imprinted directly onto the frame (instead of a metal 'tag' fixed to the bike').
This V5 frame number is used in all my insurance and 33bhp restriction notice! Where do i stand on this?
I hae no idea what to do and were to go/ who to ring? Any advice would be great!
(p.s. i didnt purchase the bike as a cat c write-off and i purchased from a garage!!!)  ____________________ Dave

Well first off has to be to go back to the garage and tell them ____________________ bikes: SV650S K5 that is making me do this 57 CBR125 RW-7 - sold ; 54 CBR125 - anyone wanna buy a project?
YOU ONLY NEED TWO TOOLS IN LIFE - WD-40 AND DUCT TAPE. IF IT DOESN'T MOVE AND SHOULD, USE THE WD-40. IF IT SHOULDN'T MOVE AND DOES, USE THE DUCT TAPE. |

Anyone know the number for ciztens advice? or other?
pretty pissed off as i paid the price of a bike as a normal bike rather than a dodgy write-off.
The DVLA told me they didnt have it as written off just stolen/recovered, but the hpi test showed both? lmao. Anyway i am told i can sort out the problem with the VIN number by sending the V5 back to the DVLA and having an inspection on the bike.
Still means i'm going to end up with a bike which is worthless and has no value (in eyes of my insurance). It might be worth 1k (i paid £1850 for the bike and if it wasn't stolen recovered it would be worth close to 2k). This is second time i've had shit happen to me with my bikes in a row. Just getting a little sick of all of it.  ____________________ Dave

first thing, never trust anyone when buying something off them.
second thing, dont worry about legal aspects etc yet. just go back to the shop and ask for your (full) money back stating why. they would be mad not to take it back on the first instance as it could save them alot of time and money should you decide to get the law involved because they wouldnt sort it out amicably.

This is a thread that's worth saving on my favorites.. I think I'll enjoy eating popcorn whilst reading this in a couple weeks!!

A load of phone calls later...
In the eyes of the law he; misrepresented the sale of the bike and the bike was not as described. im about to call the garage about this now (wont tell em about the legal advice unless they tell me where to go) lol
Going to tell em that i want the difference between a bike that would be stolen recovered and cat c and a standard bike with a clear service history. He tbh has no excuse for not telling me. If he refuses in anyway to coperate with me i have to take him to small claims court and i will happily annonce the garages name to you.
I have a polite telephone manner (so i will withstrain from shouting at him)  ____________________ Dave

As a registered dealer he should have checked. if he didn't its his own fault. If it was a private sale then i would have been screwed.
Its one reason why im trying to call him to find out his reaction to this. I dont think its fair for him to recieve a recorded letter in the post without knowing why! And if he tells me to fuck off; i'll see him in small claims court!
Just a little sick and tired of always learning my lessons the HARD (expensive) way. ____________________ Dave

Hi
Firstly the number stamped on the frame is the important one. One on a stuck on tin label is little more than decoration.
2ndly it sounds like what you have is a bike and an unrelated V5. Entirely possible that the bike itself is stolen and then someone has just sold it with the random V5 and registration plate.
Basically, sort it out quickly as legally you could have major hassle (after all, you insurance goes with the registration plate, yet it seems quite likely that the bike has no relationship to the registration plate).

DURPOL is Durham Police, which would fit with it being a stolen recovered.
But if it has a new frame number it should have been re-registered, and if you get it inspected now it will probably get q-plated. ____________________ Sod falling in love, I wanna fall in chocolate.  |

I wouldn't touch that bike with someone elses bargepole. DURPOL on the headstock? Take it back and demand a full refund.
