Check the air filter is clean and oiled if its a foam type. It might be condensation restricting the air flow.

im not sure if you mean it does it all the time or just when the weather is cold.
if it just does it at night on the way home when the temperature is cold it sounds like carburettor icing. basically ice will block the jets off where the air flows through the carb.
to test this.
start your bike up, head home and when it starts playing up, stop the engine for about a minute then start it again.
if it is ok for a while and then plays up again that will be your problem.
if it does it all the time, day and night then it may be more of a fuel filter or carb problem.

p.s. it doesnt have to be icy for the carb to ice up. the weather just has to be very cold.

yep it only happens at night when its colder

but it wouldnt start tonight so i took the bowl of the bottom of the carb and emptied it out and it was very oily i think the oil is sinking and the petrol is floating but then it wouldnt run anyway would it ?

your main jet will take it from the bottom, if its oily then it will upset the running.
shouldnt be oily though, are you mixing the oil in the fuel or has it got an autolube pump and tank?
