Is this it?? If it was MOTd on the KM clock they sometimes write the KM reading as if it is miles. ____________________ Blackmail is a nasty word........but not as nasty as phlegm!

My previous MOT read xxxxx KM
Had it MOT'd yesterday and they put xxxxx Miles
That does my head in as the clocks are in KM as it's an import.
From the MOT yesterday my bike looks like it's got 30k odd miles when it's actually 30k odd KM  ____________________ ZX6R F3 |

12 year old ZZR6 for under a grand, in what looks like reasonably tidy fettle.
Seen them going for between £600 and £1200 depending on age, mileage condition, with T&T on them. Lower end often pretty scratty.
e-bay description doesn't offer much. He doesn't WARRANT the mileage genuine, and the 'previousely registered overseas' flag wass left empty.
So it HAD Km clocks on it, suggesting its been imported.
He HASN'T strictly declared or described it as being a 100% genunely UK bike from new.
He HAS stated the recorded mileage, as was on the clocks FITTED to the bike. Just hasn't decalred that they weren't the originals.
'Caveot-emptyor' - Buyer-Beware, second hand bike, 'sold as seen'.
He could plead ignorance to it not being a UK bike, and claim he has't mislead any-one becouse he never decalred it one way or the other.
On the clocks, he could again, claim that his 'ommittion' to decalre teh clocks had been changed was becouse he didn't know, or that he chose not to. He didn't declare the mileage warranted, he offered te bike for sale 'as-seen' you saw, you bought.
You could wave the other e-bay purchases he's made around, like the barels and the clocks, and he can just shrug and say they werwe for a 'mate' who doesn't have an e-bay account, but he met in the ZZR owners club so has the same bike! He can say he bought them to stick on his mantle-piece or anything he likes, really, cant he.
ONUS is on you to PROVE he has done something against the e-bay rules or trading standards.
He sold motorcycle. You came you saw, you paid for it.
Unless you can find something SERIOUSELY defective with the machine, like it having the wrong frame or engine numbers, or a twisted frame or something, that is WELL beyond the limits of 'reasonable wear and tear' and that he COULD NOT have FAILED to know about....
You DONT really have MUCH cause for come back....
But backing up to the top.
12 year old, tidy condition middleweight all-rounder, taxed tested, and presumeable riding OK, for under a grand?
Apart from being peeved that some-one HASN'T been as perhaps 'honest and upfront' as you would have liked.....
Do you feel 'ripped off'?
Have you been sold a bike that you CANT use?
BEFORE you did the search, you were presumeably happy that the bike was good value for money?
What's changed?
Resale value? By your 'honest' standards?
When you sell the bike, in how ever long, how much will it be worth and how much MORE might it have been worth if you didn't, to salve your concience have to declare it was a grey-import with non original clocks and unwarranted mileage?
And if you show the MOT history, showing the original 50K before clock-swap, and BE honest, do you think you'll get ANY less than if you didn't?
Its a bitch when people lie to you, but bottom line is, have you been ripped off, and is the bike any less useful to you? ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!

He has declared the milage of the bike. He hasn't said 'these clocks have done' 35k miles. He has entered the mileage value in to ebay which should relate to the number of miles the whole vehicle has done.

I think he'd have a hard time convincing a court that he didn't knowingly mislead with his advert.

He declared the milage without any suggestion that it might be wrong, which evidence suggests he was well aware.
Just as you can't say, "well, I didn't say that the claim the wheels were rust free was warranted, so you can't complain that they're covered in rust." The presumption is that your description is fact.

I thought there were actually some special exceptions giving you extra rights in regards to 'clocking', giving you a very reasonable cause for come back.
He has a bike that is likely to need a lot more maintenance than he was expecting, because the seller deceived him. |
