PostPosted: 17:50 - 30 Dec 2010    Post subject: Insurance refund Reply with quote

I took out my fully comp insurance out with eBike (for the second year running) in May this year, and by August I had sold the bike, so I duly cancel the insurance (expecting a bit of a refund).

But no, eBike have turned round and said that there in no repayment due to me, but I have to pay a cancellation fee of £75.

I wrote back and asked them if they wanted my continuing business next time I get another set of wheels...I have yet to receive a response.

Cheeky fookers...

Ordinarily I would just let the insurance run out, but because I thought I'd be due a big chunk back I thought I'd cancel instead.

Still, they won't be getting my business again...not ever!!!

I'm planning on getting a bike for the summer, will probably have it for 4 or 5 months and this seems to be the case for most insurance companys... they try and charge you for cancelling it Shocked

Even if you don't own the bike can you just say STFU and not cancell it to get a years no claims?

Confused

How did you pay it....

One payment
Or
Monthly.

If it was monthly then it could be the fact you take out a loan to pay the ins.

Raise a complaint via their process and copy the FSA in. FSA won't get involved till you have completed Ebikes process, but should you then wish to take it to the FSA. Ebike will back down as it costs them around £400, win or lose.

I paid a one off payment.

I usually will let the insurance run on, but I don't need the NCB, I've got well over the amount they state on any form anyway. But the point is, I took out insurance that I only used for 4mths...so I thought I would be due some money back.

Still if they won't play ball, I will ensure I tell every single biker I know NOT to go with them, and hope that this will trickle through to others.

since you provide no figures i can only quote this

Quote:
Outside of the 14 days cooling off period You can cancel this policy at any time and We will reimburse the premium paid on a Standard policy when we receive your certificate of insurance on a pro rata basis for the period of insurance still remaining less a £75 cancellation fee and subject to you not having made a claim or a claim having been made against you during the period of cover. You must return your certificate to us within 21 days or no refund will be allowed.

Premium / 365 = daily rate

number of days between start date and end date * daily rate = premium used

premium - premium used = refund.

if refund < £75 you owe them money. if premium > £75 they owe you money.

not hard really, and you agreed to it when you took the policy.

without some figures and dates no-one can really comment at this time,

Oh boy you have never look at the T/C of a bike ins policy and refunds then Laughing

Its not broken down into days. Its months. And usually after 9 months its no refund.

If the OP looks in his user area he will find the pro rata rates of refunds.
Remember these are not set by ebike, but by the insurance underwriters. These will be pretty much the same no matter which broker you use.
TBH ebike are one of the better brokers.

A cancellation free? Considering eBikeInsurance don't even charge for putting bikes on and off mid policy, punishing you for giving up the ability to make a claim against them seems all kinds of mental.

A smart insurer would say "Sorry you're leaving, we hope you'll try us again", but "smart insurer" seems a bit like "jumbo shrimp".

Ah... eBike! I love them Laughing

75 quid cancellation fee applies

Basically if your policy premium is 100 and you cancel 8 months before the end (like you did) you owe them money.

100 - (100*4/12) - 75 = 100 - 34 -75 = - 9

can't say i do, mainly as i've only ever cancelled 1 insurance policy mid way through, if i knew i was planning a new bike i'd time it right.

point still stands that the OP knew the terms when he signed up unless he's a moron (no offence OP). [suppose my karma will start to be bashed now]

And it is for this reason the Unfair Contract Terms Act 1977 and Unfair Terms in Consumer Contracts Regulations 1999, exist. Because of companies like eBike, who take the pee in the small print, knowing most people don't read it.

I'm not legally trained, but i would argue in small claims court (where you don't need a lawyer) that it is unreasonable and unfair. It does not "cost" the broker £75 to cancel your policy whatever they say, they're clearly on the make (especially in the multitude of examples already mentioned, where they are charging you to save them money Rolling Eyes

This is why merely signing a piece of paper doesn't give the company the right to enslave your entire family, because it's clearly unreasonable! (and illegal, obviously Wink )

No I didn't sign anything.

And just because I didn't read the terms and conditions correctly, it does not make me a moron, tosser, it means I have a stigma that make reading from backlit screens tricky. Rolling Eyes
