Not in Britain....
In the USA, cases get chucked out on the two wrongs don't make a right rule, so evidence obtained illegally, is 'inadmissible'
They often DO admit it, particularly in jury trials to have the opposing lawyer object and have it 'dismissed', and the jurors told to dismiss it... only they still KNOW of it... so it's still 'prejudicial'
But under English common law, evidence is evidence how so ever obtained, and its then for the Judge to decide on what is pertinent to the case and might be admitted, as we still have the 'Principle' all cases must be weighed on their own merit
But, he also has the discretion to offer 'direction' as to whether separate charges should be brought over the 'crime' that generated the 'illegal' evidence. ____________________ My Webby'Tef's-tQ, loads of stuff about my bikes, my Land-Rovers, and the stuff I do with them!

I wouldn't get too worried. ACPO Plc is always coming up with some daft scheme to grind us under heel. Just keep an eye on any DfT consultations that come up. ____________________ Biking is 1/20th as dangerous as horse riding.

Hey,
As above, they are 'cracking down' on people that hold the camera in their hands whilst they go along as it's surprising how many people think it's a good idea. .
Of course, they could crack down on all the idiots on the road that don't look for bikers, the 92 year olds still driving that have neglected to tell the DVLA about their eyesight-ending cataracts etc however it's easier to be seen doing something and they've picked the easy one. . ____________________ "Four wheels move the body, two wheels move the soul."

Would've been nice to know exactly what was said though. I mean, what tard uses a camera whilst driving?
