Hi,
Im posting this up on behalf of a good friend and fellow BCFer as he has no internet acess at the mo.

We both work in the same shop, have done for 2years or so. I wont name it to save an argument later.
Anyways, we are just shop assistants, the lowest of the low really. Above us in store is our supervisor and assistant manager. We havent had a manager since november, she was sacked for theft (iirc 22k-ish!!)
Anyways, I have always got along with everyone, im really good mates with the supervisor and generally get along with the assistant manager. My good friend who im writing this for however seems to be hated by her. No, hated is the wrong word, she is nasty and damn arragant to him at times. She shouts at him, calls him things, slags him off, all of which when it is genuinly not deserved. Couple of points, everyone done alot of overtime over the course of a month to re-fit the shop, me and my friend pulling 50odd hour weeks. I know it might not seem like loads, but we're both employed as part-timers. When the wages come through, my friend noticed he had not been payed anywhere near the amount he had worked. Everyone elses pay was fine. When this was raised with the assistant manager, a full scale row broke out, she was screaming up the shop at him, saying she would withdraw his pay if she felt etc.
Second time, she asked him to run from our store to the next closest, a good 25+ miles each way. Now, he pays for all his own bike, insurance, fuel etc, but said he would go to do a favour. Through no fault of his own he stacked the bike. When she found out, one of her first responses to me was something about work not paying out for damages. I thought this was a bit harsh. I know he couldnt expect them to foot the whole bill, but something would have been nice.
More recently, the supervisor while acting in charge, asked a couple of us lads to do a couple of hours extra. No problem. We pull a few extra hours each, get the job done and get the store looking presentable! Trust me, that doesnt happen often. When the assistant managed came back from holiday, she hit the roof at me for the staff having taken 'so much overtime'. I think it was only 10hours between 3 of us, over 3 days, so its not exactly alot! She says she is not going to pay anyone for the overtime they had done. Normally, the basic rota is printed off and stuff up on the notice board, if we do extra we write it on, then the end of the month the assistant manager emails it off. We had written the extra up on the board. She scribbled out my friends hours, leaving everyone elses untouched.

This isnt isolated 'cases' she is generally nasty to him, moans at him for things that he has/hasnt done, blames him for everyone elses mistakes, TELLS him he has to work tommorow, giving 12hours notice, meaning he either has to drop whatever was planned or risk loosing his job. etc etc. Me and the supervisor have spoken about this and have decided to talk to her about it. In the mean time, he is pretty bummed out about the place, understanably so.
What do you think of this? What should he do? He will see this, il leave it annonomous, he can name himself if he wishes.

If this assistant manageress respects you and the supervisor, and it sounds like she does, then the two of you should have a word with her.

I would if one of my juniors was having trouble with one of my seniors, no doubt about it. Especially if I thought he was right and entitled to feel aggrieved.

I suspect bringing an industrial tribunal on the company, which she could feasibly end up doing, would also be a sackable offence and the company have already shown they're not afraid to sack their managers.

Diversity and respect for the individual sounds lacking from this woman. Your mate should calculate what he has been short paid and formally request the payment. As for doing trips from one store to another, he should only do so if covered by the company insurance as he is not covered by his own. This needs to be explained to the woman.

I don't know much about the bike issue, but you guys are certainly being taken for mugs. The hours you work, you should get paid for!

Find a new job elsewhere and leave it.

Assistant manager or higher up the food chain, someone should be told that she is not right for the job.

This here is an issue, Doubt he is insured for business use, only social, domestic and pleasure, therefore perfectly within his rights to say no and having said yes does kind of free anyone else of any litigation.

A sad case, we spend a lot of our lives at work so it shouldn't be so miserable!

Is it a standalone shop or part of a group? If it's part of a group or chain then hopefully they have a grievance policy. Your friend has more than enough evidence to cite specific examples of times when he has been treated unfairly, down to the point of being paid unfairly and refused payment for hours worked. It's completely unethical.

Your friend would do well to lodge a grievance against the assistant manager, which will go up to an area manager if there is one. This will draw unwanted attention to her at a time when she's probably hoping to get her grubby mitts on the manager's job. It's obviously up to you and others whether you support the grievance and act as witnesses, but it will add a lot more weight to your mate's case if you can speak up in his favour. It won't earn any of you any brownie points with the assistant manager, obviously, but neither should he be treated like he is by her.

Ultimately, if he were to leave because of this behaviour, it amounts to constructive dismissal and he would have more than enough grounds to take the employer to tribunal.

In terms of riding to other workplaces, your mate is not insured unless he has business use on his policy. Most policies include commuting to a single place of work. Multiple places won't be covered. He should also be paid mileage for business travel, and if he's not, there's more fuel for his fire.

I hope that helps. It's not going to be an easy journey, but there aren't many more choices!

Maybe there needs to be some kind of mediation meeting, where they can get together in the same room and get this all talked out and get a basic understanding of what it is that is causing the friction / character clash.

A confrontation like this is quite awful, but often massively productive and will clear the air and get things sorted out and into the open.

Two people going in to speak to this other person will likely make things worse. IMO. Thumbs Up

Are you sure the assistant manager doesn't have a crush on him and is doing that 'opposite' thing Wink.

Anyway seems there are two options; official or unofficial.
Get the ones being treated well to have a quiet word with the supervisor and ask "what's up".
Go through official procedures and contact head office about the behaviour, filing an official grievance.
Either could possibly make things worse.

As for crashing his bike - I would absolutely not expect the company to pay out if I crashed my bike on company time. I would be being very apologetic if it had inconvenienced the company.
Of course it's quite likely, as above, that his insurance doesn't cover it and he shouldn't have offered to do it by bike if he wanted to stay legal.

Whatever happens, I'd strongly suggest he makes a diary of every single issue that's happened - which will be very useful if things do get actually ugly.

Hey,
Snow rider was never beaten up by my dad!! I'm shocked he would even make an accusation!

When he was 16 he turned into a little sh*t. He was always drunk, possibly doing drugs and gennerally abusive to my mum and Dad. The only time my dad grabbed him is when he squared up to him; Dad never hit him but pinned him agasinst the wall. To my mind he deserved it and the way he treat dad he was lucky he wasnt beaten to a pulp!!

Yes my dad is a guy who will take no sh*t and knows how to handle himself but is certainly no bully. This is the same guy who is paying for Snow Riders engine, keeps a roof over his head rent free and feeding him. Nice way to show your appreciation!!

I'll normally stand up for Mark but sometimes he very out of order.
