On Friday, I was going to work, not particularly fast the van infront of me indicated left and slowed, so I slowed too. As the Van turned in I put a bit of throttle on to overtake, at this point the van was half in the junction to go past I didn't need to go into the other lane. I was dong about 20/25 when a car appears and I think 'Fuck' the car hit my foot and the side of my bike which sent me over the bonnet and lying in a heap staring at the front of my bike with a car near enough in my shoulder.
I thought about getting up but decided the floor was the best place for me and laid there and wondered if I could have a sleep. Then a mass over people appeared some trying to take my helmet off which I promptly told them to leave it. Then I could here talk of 999 police ambulance, someone crying and general alarm. Someone then placed something soft in my back which was nice and made me comfortable. I then decided I was going to get up to which I told to lay down and not move, as I was comfortable I agreed. Then came pain in my foot, it hurt like buggery and I was generally aching. My field of vision was extremely limited, I was laying almost parallel slightly wonky facing the other side of the road with my back to the junction. The was a guy in front of me on the blower to 999, they must of asked him how old I was the guy crouched down and said "err about 30" to which I replied "cheeky sod I'm 24" there were a couple of chuckles and I think the situation was defused. As I was only 5 mins from home I got someone to call my dad and he came down, and greeted me with his trademark "'ello bonehead" The paramedic then arrived checked me out and let me get up, as I was getting up my Mum arrived in tears, she had seen a police cars 2 ambulances a crowd around me in close proximity to the car. She had thought it was serious and I was under the car. That was quite tough to see I think her and the lady that hit me where far more upset that me, bloody women . Anyway I got up and went to the ambulance and checked me over, my only injury appeared to be my foot, which hurt like buggery.
Police spoke to me, and it turned out everybody said the same thing. witnesses other driver etc. which made it easy. The copper said really I shouldn't have gone past the van without making sure it was clear but obviously the woman shouldn't have pulled out. He said the insurance would rule in my favour. I spent the next 4 hours in A&E to be told there was nothing wrong with me. Approximately 90minutes after the accident I got a text from my dad saying the ladies insurance company had rung up declaring full liability. Which is a result. I reckon the TDM will be a write off, damaged link pipe, footpeg, hanger, fork bottom, mudguard, handgaurds R&Gs battered. Then lots of scuff on the indicator mirrors etc. A crack in the bellypan (what was there before but sshhhhhhhhhh ) Still with any luck I will get £2.5-£3k and an option to buy the bike back. There is nothing majorly wrong after bodging a footpeg on and bending out the hanger the bike was fine in fact it passed an MoT today. Tomorrow the bike is off to an old friend of my Dad's who happens to work at MCT Suspension for the bike to be set up for me. It will be with them for a week then back to me and off to the insurers to be fixed/written off.
Luckily I was wearing nearly £1500 worth of gear that was sufficiently scuffed enough that I can claim for it!

If people are interested I will post pictures of the bike but there isn't really much damage ____________________ Well, you know what they say. If you want to save the world, you have to push a few old ladies down the stairs.

Eeew ingrown toenails. They hurt like buggery too, and will do for months. Glad you are sort of ok ,theres a lesson to be learnt here as has been said you really shouldnt have gone round the van if you couldnt see if it was clear or not ,and i know the car driver should not have pulled out either but that wouldnt have been any help to you had the outcome been far far worse even fatal ,youre lucky the car driver has admitted liability ,it could have been a long drawn out carry on if they hadnt .You should always treat junctions with traffic in them or blind junctions with great care they are one of the most dangerous situations a motorcyclist can find him/her self in , but youve learnt the hard way and as it happens the outcome isnt too bad  |

Could you not see the fiesta pull up as you were approaching? Not always the case I know.
As said it wasn't defensive riding, liability wise you're ok but that is only a legal issue, and having it go in your favour doesn't help if you're dead.
Glad you are ok and walked away from it

I really wouldn't really call it overtaking or going round the van, (dispite what I wrote in the OP! it had turned off, it was taking up less than half of the road. I think I moved 1-2ft right and proceeded on my way I was well on my side of the road. If I had been in a car I reckon I still would have hit the woman. Put it this way I definitely wouldn't have pulled out in her position even on a bike
As to how many times I've been off the TDM...
1st looking at a girls arse when the car in front stop and slammed on did a stoppy and came down on one side.(100% my fault)
2nd decided it would be a good idea to ride to work in a blizzard fell off going down a hill.(100% my fault)
3rd hit by a drunk pedestrian running across the road (100% nothing I could have done to avoid this)
4th a woman turned into me whilest trying to get into a petrol station (100% nothing I could have done to avoid this)
5th Clipped a lorry whilst Filtering (100% my fault)
6th I think there was gravel on the road, touched the front brake and on my arse whilst filtering(100% my fault)
7th this one
I tell you what though the TDM crashes VERY well Still on Original Indicators
I'm back on the road already took it for an MoT yesterday and dropped it at MCT for some suspension work today.
Foot feels loads better today ____________________ Well, you know what they say. If you want to save the world, you have to push a few old ladies down the stairs.
