I recently sold my bike sometime ago and get a letter from them wishing for me to pay a fine, a 'bribe' in Rogerborg's word more like about not notifying the DVLA change of keeper. They want £55 to settle out of court.

I have draft my letter as on the same lines as Dean - J in this thread https://www.bikechatforums.com/viewtopic.php?t=247226

So I basically to summarise, the V5 has been sent off.
Then a letter from them saying someone wishes to apply for the log book. So this was filled in and sent off
Then they want a fine or court action.

Sorry its not that long a post but I'm seriously pee'd off by this.

Sorry rant over

No love lost here either... they're a bunch of wankers. I still have debt collectors phoning me and sending me letters. Bunch of fuck wits.

I still get tax reminders on a bike I scrapped over 6 years ago.

best thing to do really, your not really paying the extra for recorded delivery, your paying for the peace of mind that in these events you have solid evidence you posted them *something and they accepted it* (thats where they are likely to argue it)

at least, thats how i see it, others will undoubtedly just see it as paying extra for something you shouldnt have to, and quite rightly so.

I've given up on them. A mate of mine has to, EVERY YEAR, SORN a car he wrote off then scrapped 19 years ago. They lost the V5 that he sent in to them so they think its still on the road if he doesn't SORN

But the point is you dont need to have proof you sent it, THEY must prove that you didnt. Innocent until proven guilty, and they cannot prove that you didnt send it unless you admit to it. Hence why if you fight back with a letter as per i posted previously, they WILL drop it.

Bummed DVLA twice now, they are useless when it comes to the interpretations act.

true, but 9/10 times its alot easier to make companies/organizations drop the claim against you when you turn around and say "yeah? well this proves that i sent it in".

Much as I agree that the onus is on them, you can be darn sure that I get a "certificate of posting" from the Royal Fail for anything that goes to Swansea. Costs nothing, and you don't need proof that it arrived, only that you posted it.

although this is handy I believe its not a requirement to have proof of posting, just merely a statement that I post it.

Absolutely, you may want to have a search for the sickpup vs the DVLA saga where he schools them good and proper.

It's the DVLA - why would you bother with any lube in the first place? Give them a taste of their own medicine: use powdered glass.

Have a look over my dealings with them.
It might be of some help. Thumbs Up
