.... a second hand bike that is, could you get your front caliper seals and fork seals replaced under the warranty?

My dust seals fell out last week and the fork seals are almost dead, I've had the bike for not even 2months (bike came with 6months warranty) and I've been told the warranty doesn't cover this Confused Sad

Surely the warranty would cover this and considering I've only just bought the bike off them?

Hi

It would depend on the wording of the warrenty. However I think that under the new rules the selling dealer would pretty much have to fix these defects.

Only thing is that they could claim that these are service items, but that would be stretching the point with fork seals and not true at all for the brake caliper seals.

All the best

Keith

If you're thinking of the Sale of Goods Act, introduced a few years ago, that only covers the first 30 days. After that, like you said, if the warrants doesn't say its covered, then its not.

Hi

No, there was a very recent change in the law requiring dealers to be responsible for faults occuring in the first 6 months (with the only get out clause being that the seller knew about them whan they bought the bike).

All the best

Cheers for the info!

So I've got a good chance of claiming for these to be fixed under warranty? If so, I'll be sending an email first thing Monday Smile

Jon, I wouldn't send an email, but get on the phone to the MD of the dealership. You need to quote precisely what Kickstart is talking about (whether it be a regulation or specific act). You should get positive response. If he tells you where to go you will have to say you will be onto the local trading standards and report him for selling defective goods, oh and by the way are a member of a national online motorbike forum with thousands of members and you will have no alternative but to tell them to avoid the dealership!

Let us know how you get on!

Hi

Think you need to find the specific rules, etc. Sorry, cannot remember them myself, but I know they changed recently.

All the best

i always assumed that any "goods" sold in this country should be fit for the purpose they were intended for, if your seals fell out cos they are faulty then the bike was'nt "fit" however watch out for the wear and tear bit, they may try that angle you will have to prove that they were faulty at time of sale......... good luck!
