A local council has banned just motorcycles using a road near the famous Ace Café in North London as part of a six-week trial following months of complaints about anti-social riding and racing on the road.

What a great comment from someone

Quote:
This is typical of modern Britain, a small minority of people misbehave, the Police have the powers to deal with them, but instead the representatives of the Nanny State at the council impose a blanket ban on all Motorcyclists. No doubt they will have enjoyed doing this as they know from the Guardian, motorcyclists are likely to be white heterosexual males which in the mind of a Guardian reader is the same as a rapist .
Of course the sought of person who rides dangerously in a residential area will simply ignore the ban and no one will stop them, because the Police are too busy investigating a celebrity putting his hand up a groupies skirt in 1974, or ungluing some woman with hairy armpits from a drilling rig.

However the law abiding rider will follow the ban and so be punished for a crime they did not commit.

It would be good if the BMF legal challenge is successful as this could be setting a worrying precedent.

Also can you really just close a road for bikes? Suppose you can for cars etc so I guess its possible.

What happens if you go down there anyway?

It's a road near the ace cafe. Not the one at the ace cafe.

It's basically near the hospital and industrial part.

Can still go ace.

So let me get this straight;
Nimbys are up in arms about 'all the bludy Bikers' & moan at the council.
Council moan at the coppers.

Coppers fail to 'remove' the problem, by turning out in large numbers, and harassing the bikers; let alone banging them all up for ALL of these illegally noisy machines and dangerouse riding antics, under statutory road laws.

So coppers go to the courts and get 'Dispersal orders'.... to prevent people gathering..... Fail to effect disired outcome of making all the bikers piss off with them either...

So council... by some dint of the TRO legislation for roads maintenence, or by by-law.... impose a traffic restriction making it illegal for BIKES ONLY to go down a certain road......

So... if the bikers were breaking the law to begin with.... and that remains in doubt..... they are hardly likely to be further deturred by a 'No Bike' sign!

And if coppers cant get proper convictions for REAL crimes like speeding or dangerouse driving.......

Oh! No... the new law means that a bike only has to BE there.....

RIGHT... now I get it.

Then end of a very nasty wedge this one.....

Why that road? Have I been missing some stunting? Every time I've been to the ace the people have been riding around outside the front of the ace itself.

As far as I can tell, Rainsford Road isn't even on the same side of the North Circ as the Ace.

It looks like an industrial estate on Google Maps. Seems a bit pedantic, really.

I could sort of maybe a little bit understand a really heavily built up road with a school crossing on it or whatever. It'd still be ridiculously harsh and Political Correctness Gone Mad and whatever.

But that place? Surely that's where you want the troublemakers, far away from kittens? There's a hospital... but so what? Ambulance drivers are highly trained, right?

So if cars where doing the same 'disruptive driving' in the area, they would i presume ban cars - i.e lets say 90-95 percent of what uses the road, from using the road Thinking to be fair and non discriminatory... right Thinking ?

It's past the petrol station on the left when you come off the a406

It's not the ace people were complaining about it was there.

Very quite roads with loads of mini roundabouts.

Loads of people would drag or race down there. Was pretty cool actually

And Cansa, some people actually presumed it was the ace cafe road!
Even speaking to some people on Friday suggests most people thought ace cafe was a no go

So was merely highlighting a fact

How will this be enforced?

Police/Camera Presence 100% of the time?

A sign by the road, which will get knocked over... ?

That quote is incredible - it's clearly a Daily Mail reader, perfectly describing a Daily Mail reader but claiming to describe a Guardian reader... Laughing

Ace Cafe could be very fun on Friday during the summer as a biker, but I see why residents would be unhappy. Not everyone likes noise and sometimes the bikers would create a lot of traffic.

However the road blocked isn't the Ace Cafe one.

I'm pretty certain this sort of prohibition is more-or-less entirely unenforceable.

I'm inclined to hare up and down it out of principle now.

Road Traffic Regulation Act 1984 S6 (3) (d) allows orders specific "to traffic of any class".

Although what's a "class"? It's not defined there. Highways Act 1980 Schedule 4 lumps motor cars and motor bicycles of at least 50cc in "Class I", but that's for purposes of "special roads" (i.e. motorways).

They can certainly try defining motor bicycles as a "class". Who will stop them?

Clutchy wrote:

Verrrry good question.

Traffic Management Act 2004 allows for civil penalties which is likely what they're sniffing after, but what's the offence?

RTA 1988 36 (1) or Traffic Management Act 2004 Section 8 create one, but only when ignoring a sign defined by Regulations (and I don't believe there is one for motorcycles and peds) or "authorised by the Secretary of State".

So they'll have to apply to Hammond for permission to create a sign, and until and unless it's authorised, it has no more meaning than a "No minicabs, white vans, Nissan Micras or tarts in 4x4s" sign put up by me or thee.

I trust that the BMF and MAG will know this and will be sorting it out. A judicial review would be an expensive way to do it, it would be cheaper to just ride past the "sign" with care and consideration and try to get prosecuted or civilly penalised, although that points right at the elephant in the room:

If folk were hooning up and down that road, then they could have been stopped by policing it.

If folk now ignore the "signs", then they can only be stopped by policing the road.

Either way, the solution isn't a sign, or an order, it's putting Dibble on the street.
