Can some one clear this up for me? I've to 2 cases in point that I'm not 100% sure of.

1st instance: the bike tax runs out the end of the month, I'll be sorting it but keeping its insurance running for my NCB as its only costing around a tenner a month. Will most likely SORN it. Is this legal?

2nd instance: the car insurance runs out in Feb, but the tax not till mid way though the year (June). I'll be getting a company car late Jan/early Feb so most likely wont be re insuring it if the company car comes before renewal (new job starting 28th Jan). Prob sell it when time allows but in the mean time i'm going to have it sitting with tax and no insurance. Would like to keep the tax on if possible as it will increase sale value. Is this one legal provided its offroad?

TL;DR taxed but not insured, Legal? insured but not taxed legal?

First, legal.

Second, due to the new stupid law, no longer legal, would have to SORN the car when the insurance runs out.

You HAVE to SORN it, otherwise you'll get an auto fine through the post. Keeping the policy running won't be an issue, though.

You'll have to send the tax back and make a SORN declaration, otherwise you'll get an auto fine.

When arry says "fine", he means "demand for a bribe in order not to be prosecuted".

You have to be very unlucky to be prosecuted, since that costs them money rather than raking it in. I ignore their blackmail demands, none of them have ever come to anything.

Such an accurate statement of the DVLA! will take it into advisement although I most likely will be the unlucky one you speak of!

heres the kicker, spoke to my insurance about insuring both my bikes, they said i couldn't because they wrongly assumed one of them was sorned.

so they said i couldn't insure it because its sorned?????

how the hell do i get it to the mot station to have it mot'ed as i cant tax it till it is,

now here is where i think legality is, you can insure anything (even if they say you cant)

but you need mot to get tax and insurance to get tax

so firstly you should be ok

secondly you could get a refund on your tax but i believe as long as the vehicle is off road it doesn't matter if it is taxed or not,

i believe you can still use a vehicle without tax and mot provided you are going to or from a place of repair or testing (mot) and the only time i have been "pulled" for no mot or tax i told them where i was going and they where happy for me to proceed as i had insurance for the bike,

My friend in the same situation also had the same thing though the police officers did ring the garage to confirm the appointment.

just as a side note my information was last used in 2010 not sure on law changes but i believe it is still accurate

I have learn't the hard way that any vehicle on the road has to be insured, full stop. nothing else like TAX/MOT status matters.

Any vehicle that is SORNed can be left without insurance.

They are the only 2 options.

They won't issue a new tax disc until you pay any outstanding 'fee/s'.

It may also affect the next registered keeper taxing or registering the vehicle if you sell/give it away.

And trying to fight that one when it's computormated is worthy of karma that bcf don't provide.

Not even at a Post Office, where they barely seem to register you are there, let alone make stringent checks on documentation?
