Can you believe it! Had my bike booked in for its first checkup and en route got knocked off my bike!

First vehicle at the roundabout, sat in the left hand lane, indicating left waiting for a big artic lorry to go past when all of a sudden im sent flying forwards and the bike lands on top of me.

Oldish man emerges from the driving seat along with his wife from the passenger seat. First thing said to me?

"What on earth was you doing overtaking on the left?" said the woman.

Pulling my leg from under my bike I saw red with this comment and replied

"How dare you accuse me of being at fault. I was sat stationary in the left lane indicating left. Could you not see me sat there?"

At this point her husband come forward apologising and correcting his wife that it was my fault at all. Must admit, after this they did become very apologetic.

Phoned the garage to tell them what happened and that I was going to be late as bike would need to be recovered by the AA as appears the gears are knacked and fairing falling off. Very kind people at garage actually came and picked me up!

Apart from a sore ankle and a dull pain in my lower back, all in one piece. Just got to wait to find out what the damage is now.

Good thing is that it hasn't put me off riding. Cant wait for it to be repaired so i can get back on it now.

Please tell us you got witnesses to give you their details. When you SHOULD HAVE CALLED THE PIGS!

Because you can bet your ass the old grunter and/or his scumbag criminal insurance company will attempt to commit criminal fraud by claiming you were at least partly at fault.

No witnesses im afraid. No one else stopped. By the time I had got up, all the vehicles that would have initially seen the accident had gone.

In fairness, didnt report to police as at the time I didnt think I was injured. Its only as the adrenalin has started to wear off that im feeling the bit of pain.

Got all their details. They also have damage to the front center of their vehicle where they hit my back wheel. As the woman moved their car out the way she came back saying to the husband that there was a really strong bad smell in the car.

Just waiting for the garage to get back in touch with a quote. Will then phone the couple to see if they want to settle outside or go to the insurance.

After reading a lot of things on here I think if you can't get a witness then call the old bill at least to take a note of them admitting it, a lot of people that have time to think and reflect somehow then come to the conclusion it wasn't their fault !!!

You could report it, but to be honest if you were hit in the rear and there is damage to the rear of your bike and the front centre of their car, there is pretty much no way you could be at fault. Insurance company will see that and the decision will be made at once.

Seems like a stupid question but I assume when getting the police on board you would call 999? Not really an emergency but if you called the station, would they even bother turning up?

As I've said in many threads. Don't move the vehicles, call an ambulance if you've hit the deck and police have to attend.

Thanks for your replies everyone. Certainly learnt what to do should I be unfortunate to be in a similar position again.

Just got back from minor injuries. Got bruising to the ankle and pulled muscles in groin and lower back from where my body turned as I was going down to the ground.

Just had quote back from garage. Esitmate of parts and repair including vat comes to £1017. Plus as hemlet knocked the ground, will need to add another £100 to replace that.

Going to call the couple later and see whether they want to settle outside or go through their insurance.

At those estimates, insurance is the only way you should be going. Especially with that personal injury claim, from what you're explaining..


Edit: Don't suppose you took photos of the vehicles at scene?

Contacted the couple. They are claiming it was my fault! Apparently I undertook them on the left and pulled in front. He said he only lifted his foot of the clutch slightly!

So angry with the utter BS!

All reported to the insurance company. They said not to take much notice of what they said. They have plenty of experience and have heard it all before so not to worry.

If I ever get knocked over like that I'm phoning an ambulance, that way the police haven't come and take statements, which hopefully hold their grunt when you take them to court for your injuries.

This is why, a police report from the scene is always handy.. and an ambulance report to back up injuries...

DaveUk, you seem to be too mild for your own good. Get on to your insurance company and make sure they pursue the case aggressivly.

My plan for any incident is A: just lay on the ground like a flatfish till an ambulence and the cops come and B: take photographs and get licence plate numbers not just who ran into me but witness cars as well.
I actually carry a small waterproof camera with me for this purpose as well as two mobile phones.

I wouldn't worry about it. I've never heard of a rear-end incident not being the fault of the following driver. The fact is he hit you. All drivers are responsible for being able to avoid hazards in front of them, this person didn't.

If you really want to make a fuss report him for insurance fraud. In a thread recently the same thing happened to another member (who was in a car, not a bike) and the police found CCTV of the incident and the fraudulent bloke did time.

I'm afraid to say, this isn't going to turn out good, you might get 50/50 at best, but with no witnesses and no police it's your word against theirs.

Fucking hate people, I'd have lamped the bitch for getting out of the car and saying that.

Thank for your replies everyone. Everything with the insurance company now, so just got to wait. Going to be buying myself an action camera that I can clip onto the handlebars and record by journeys in future. Certainly not going to be called a lier again.

Just been up the same hill with the missus driving. We travelled behind a bike so I got the camera out on my and recorded it. According to the other driver, I undercut them and pulled infront at the top. As you can see from the video - there is no room to undercut any vehicles! Might send this off to the insurance company to show them the other persons story is BS!

Terrible road positioning from that moped.

Why didn't you photograph the vehicles at the scene?

Remember for the future: ambulance, photographs, police report. Hope you can get this sorted through insurance without taking blame.

Usually happens on this forum, third party say they'll pay, avoiding insurance, until they get hit by a quote and change their story. Happened to me too, still won. Twice actually.. Thanks to photographs and a police report.
