In the UK your suggested course of action would be saying "It's ok, I've seen you, you can go" - if the driver in front was also thinking of overtaking, you'd be doing what is commonly used to tell the driver in front that it's safe for them to perform the manoeuvre.

A good way to end up dead AND wrong Wink.

On that particular video the biker should not linger at the side of the car. Get round and get back into your carriageway. The car driver did not observe correctly.

In the uk I'm sure the Highway Code says that you should only overtake when it is safe to do so(or words to that effect, the words should and must can be defined but in a claim the Highway Code can win a case if used correctly)

The bike was overtaking so it wasn't safe for the car to overtake, hence the crash! Had it been safe to do so there would have been no collision!

So the poll is shit because being safe is the default stance and being right and dead is not much of an option! If the collision occurs and you are alive hen being in the right is the next best thing to get full damages and payouts. That's my view!

In that particular video, the VW driver SPED UP during the course of the bike's manoeuvre and emerged into his path. End of story.

On the flip side - I would've overtaken a lot faster, but if you try a fast overtake it leaves you less of a chance of stopping if something like that happens.
