eBay resolution, advice please?

Hi,

I bought a phone off eBay described as unlocked. When it arrived it needed a network unlock code to work on either a Three or O2 sim.
On asking the seller as to what to do they agreed to purchase such a code from the www (rather than a refund) and asked for IMEI number, which I immediately supplied. That was about a week ago. I contacted them on Wednesday asking if they'd had any success, and again on Thursday saying they had until Sunday to provide a number, agree to a refund or I would be going via eBay disputes.
It's now Sunday and on logging onto eBay it seems as I had used a 'Guest account' - eg paid using the pp system but with a Visa Debit card directly - I need to contact PayPal - basically they've washed their hands of it.
I can't find a spot on the pp site to raise such a dispute, does anybody have any ideas how I should go about this please?

It seems the whole 99% claim depends on paying with PP though an account. I'll look again tomorrow when I've more patience - failing that it's £25 at the on line small claims court. I suspect the seller imagined I was trying to pull a fast one, and so thinks I won't take this any further...

Phone paypal and explain it. I did the same once and it was resolved.

Tell paypal if they're not going to honour their buyer protection policy you'll have no option but to contact the card provider.

Visa give the same protection to credit and debit cards making them joint liable for the sale, speak to them, say the item is not as described and attempts at resolution have failed, that paypal are not responding and the card issuer will take the money off paypal and sort it.

or is there a minimum for this?

It's a Samsung. I was quite happy to have the phone unlocked previously but now as a matter of principle I'm after my money back. It annoys me the buyer being 'oh no I didn't realise, I'll pay myself' then suddenly just ignoring me. I've not been pushing the point, my initial pleasant queries were answered immediately but when it came to the crunch they have clammed up. I deliberately gave them five days and into the new year before I've gone to the stage of pp or EBay resolutions in case they'd suddenly gone on holiday!

Depending on the exact model, the most it'll cost you is £20. Now when you think, sending it back will cost around £8 if you use special delivery plus post office walk, you'll break even and get the phone you want

Will it? If you go via Paypal and they insist on it being shipped back, maybe. Go by your card provider and your stance it "I'm in Saturday, arrange a courier"

Quick update, quick question!
PayPal have looked into this and decided in my favour, and I'm now waiting my payment. However they say if the money to refund me isn't in the sellers account they'll do what they can, including suspending his account.
That's hardly a major threat, surely?

They will take the sellers account into debit so technically he will be overdrawn you get your money back and they suspend his paypal and ebay account untill he pays up.

They also eventually give the debt to a debt collection agency who will go after him for the money and they dont give up!!

That will have them quaking in their boots. Given that paypal did not provide the goods only the service of moving the money....

Just to make you aware Visa are NEVER liable for anything on their cards.
Visa do not speak to customers.
I can only guess you are talking about CCA. Which only covers credt cards and does not cover purchases via a 3rd party such as paypal
