Got a derbi Terra just changing oil and air filter and found this oil sitting in the housing

I can't tell how much is actually in there, but the crankcase breather goes into the airbox, so I wouldn't worry too much.

A lot of airboxes have a drain on the bottom, have a look see if yours does (usually a tube with a bung on the end)

mine did that too, there is a bung at the bottom of the air box it does get blocked so I drilled mine the next size up

Cheers ,cleaned it out with tissue, I can see a rubber bung further down towards the carb/engine but looks as dry as a nun
..

Tried changing oil what a bastard it is!!!
Think I need 23/24mm socket as can't get a wrench to it without taking engine guard and gear lever off!!!

Oil in the airbox most commonly occurs if you fill the engine with too much oil. Make sure you have the bike level when checking the oil, and don't fill it past the max level line

Seller put new oil in before I bought did look high on the dip stick but its hard to read..
No max or min mark

Going to empty and put own oil in

don't forget the filter behind the plastic cap, there is a little rubber o-ring behind the plug, make sure you use only a six sided socket on the plug as it IS made of brie

I once emptied my airbox from the CX and it came out at 2 pints. Mind you, mine was more vapour particles turned to liquid. The vaccum on this bike goes downwards into the box from the rocker cover so there is no natural return of the vaccum through gravity when you let off the throttle..

Nevertheless, with that colour oil it looks like the bike's been overfilled, as others have mentioned.
